I played dv 2022 for my mom and other relatives children who lives with her and they were successful 2022AF72*** then I submitted the ds 260 application a week ago already. She is in the process of getting the adoption papers for the children but my question is. 
1. Can she get a new birth certificate and passports for the children when they are adopted?
2. Can she change their last name or they can just keep their original biological parents last name?
3. If name change then I’ve to contact kcc to unlock the ds260 for corrections, will it not be a problem for the entire process?
4. If the process will be complicated or an issue, can she contact kcc to just remove the children’s name from the ds260 then my mother can travel alone? Will this also be a problem?

Note: the children already have birth certificates and passports which has their birth names on it.

I would imagine a lot of this is dependent on the country she lives in.

 

These children are orphans.?

Who exactly did you list on the entry? You say

Who is all the “they” on the entry? Or was it just your mom on the entry form? 

 

Adoptions that are eligible for immigration are a complicated process. As above, it partly depends on procedures in your mom’s country too.

Well, does she consider them her children or not? Does she want to live with them or is this all just a ruse to try get them green cards, and she’ll just leave them behind if that doesn’t work out? Because quite frankly this is what it sounds like from what you’ve said here.  How old are these children?

 

If there is any misrepresentation of a fact to try get anyone a green card, your mom could face a permanent ban from the US. Sudden adoptions after winning the lottery are as suspicious as sudden marriages. They may or may not be bona fide but you can expect a lot of scrutiny around the process either way.

I listed my cousins and my mother on the entry.

she wants to bring them all to the states because they are her nieces who she has been taking care of since they were born and the oldest is 16years old. She took in the children’s parents since the end of the Liberia 2003 war, accommodated them, send them to school etc.

 

the reason for asking if she can remove them from the list isn’t about neglecting them rather it’s about the financial situation and the time frame but she definitely wants to bring them all with her. Also she adopted them legally before the dv entry in 2020 but the legal system takes forever to get the paperwork done that’s why the children still have their biological parents names. However the paperwork will be done soon.

Doesn't sound like they would qualify as derivatives in this situation.

I’m sorry, you’re contradicting yourself. Either they have already been adopted, or they haven’t. If they were not finally legally adopted (that usually includes paperwork, which is the last part of the “final” process ) before the entry then they are all disqualified anyway. If the adoption was finalized before then it seems very strange that you state she’s still in the process of doing it. Names don’t matter, final legal adoption date does.

 

All that aside, with the childrens’ parents still alive etc you may find these adoptions are not accepted for immigration purposes.

7. “Adoption Order” means the document issued by the presiding judge authorized by law that finalizes an adoption.
 

Did your mother have adoption orders issued by the judge for all the children listed on the form, before the entry was submitted?

Yes but the certificates haven’t been printed just like the birth certificates and passports, we just received them this month. The system is super slow, trust me.
