So, submission is ASAP, since they are already at NVC.

Hi everyone,

 

Filling out the i-864EZ.  Under Part 5 Information About Your Employment and Income, it asks for Employer 1 and Employer 2 (if applicable).  I actually have two jobs, but with my 2nd job, I recieve a W2 but my income fluctuates a lot.  This would make it hard to include it in my annual income which they are also asking for in this section.  My primary job fulfills the minimum 125% poverty earnings requirement, so do you think it's ok if I don't list my 2nd employer on the i-864EZ?  (Actually I had 3 jobs in 2020 with 3 W2s.  I hope this won't be confusing if I just use my primary employer.)  I don't want to leave anything out.   Thanks for any advice you can give!

You are going to submit your 2020 tax transcript or return, correct?  That will have all three.  IMHO, use all three as your income.  They are not going to care much about your second and third income fluctuating if your primary income is over the 125%.  Just shows you are a hard worker!

An employed person's current income does not come from any tax return.  They should treat the tax return section as if it is a different set of questions from the current income.  Tax section is just information.  Current income is how they qualify.

 

So....Yes, it's ok to just list the primary employer and the annual income from that employment.  The entry should be the gross pay for a full pay period times the number of pay periods in a full year.  Example:  $1,000 a week is $52,000 a year etc.

And it's ok to use the i864 EZ?  My husband thinks if you have more than one job with a w2 for each job, you cannot use the i864EZ, but it's not one of the 3 questions which determines whether or not you can use it, so I think I can still use this form.  In fact, on the form I-864EZ it says "Employer 1" and "Employer 2".  Is that correct?

You can use the form, but if you have doubts, just use the regular one and skip the asset section.

Hi Everyone,

 

I know that it's optional to include the two previous year tax returns with the i-864EZ.  I'm happy to submit them, but I'm wondering if I should since my 2018 tax return was a married filing jointly with my ex husband, and the total income on that return was our joint income so it doesn't really show my individual income for the year 2018.  On the other hand, is it weaker to just submit one year's tax return?  Thanks!  I am searching the sight before posting these questions, and I couldn't find an answer. ;/

You need the transcript, which is the only evidence of filing.      Why do you not have it?

It hasn't been processed yet.  Due to COVID.  They've just begun processing the ITIN we applied for with the return.  They are super behind!  There's a whole thread about it:

Well in that case, submit the 1040 with all of the supporting documentation.  Maybe by the time the interview rolls around, you will have the transcript for him to take to the consulate.

 

Like I said, it is preferred because the return and W-2 are not evidence of filing.
