Has anyone ever had to do an I-134 Affidavit of Support instead of the I-864?

My husband recently became sick and has started a new job, and needed joint sponsorship for me. After informing NVC about this, they told him to d/l the I-134 form and fill it in. Everything I find seem to point to I-134 being for Fiancee visa, not spousal.

Anyone else heard of this happening? Or is it a special case? :help:

The Beginning

September 29th, 1999 - 'hooked' up with Dave after chatting with him for about a year online.

October 23rd, 2004 - September 29th, 5 years to the day, he proposed to me =D

July 23rd, 2005 - Dave comes over for the wedding on July 27th at the beach :)

Sometime in December, he sends off I-130 to Texas and promptly leaves me in the dark like a mushroom x.X...

The Saga Continues *dumdeduuummm*

August - phone NVC. intriguing :\ Phoned again, ah hah! the truth... no record of us >< losers... Go and visit Dave for 3 months...

End of January, we sent the petition back in again. 2 weeks later, we actually get a number in our hot little hands.

April 5th - NOA2 approved!

April sometime, received and sent back Choice of Agent

May 18th - Received IV Bill

May 28th - Sent IV Bill MO back

June 11th - DS-230 generated

July 12th - Received and sent back DS-230 packet

July 19th - NVC Sent Husband checklist of AoS. They forgot to fill in N/A fills with.... N/A x.X

July 23rd - DS-230 entered

July 26th - NVC received checklist regarding financial suppliment (ie, got a talking to on the phone :P)

August 1st - sent financial papers back

August 3rd - (Automatic msg) Financial records lacking! ARGH!~

August 7th - Received actual fixed paperwork - 'processing'

August 17th - NVC COMPLETED CASE!~

September 10th - Received packet 3

September 17th - Medical in Brisbane

November 14th - Interview VISA GRANTED

December 8th - Landed in USA

December 24th - GreenCard Arrives

That sounds strange to me. The I-134 is non-binding and is for non-immigrant visas. The I-864 for is binding and is for immigrant visas like the CR1/IR1. For joint sponsorship for the CR1/IR1, the spouse fills out the I-864 as the main sponsor no matter what, and the co-sponsor fills out a second I-864 as the joint sponsor.

2 June 2007 - Received Packet 3

12 Oct 2007 - Sent Packet 3 back by special delivery

5 Nov 2007 - Interview in London - Approved without any hitches!

7 Nov 2007 - Visa and MBE arrived by SMS! :)

30 Jan 2008 - Fly to Michigan!! :)

*Note: Any delays in our case are only due to us taking things slowly

I had to submit an I-134 for my CR1 Visa - in this case at the Embassy Interview I was told that I'd filled out the wrong forms for the financial part (my wife had done an I-864 and her father an I-864A) - what I was asked to submit was an I-864 for her Father (who was a co-sponsor), an I-864A for her Mother (who was a household member of the co-sponsor, and as she filed a joint tax return with him each year they needed an I-864A from her), and then an I-134 from her Mother as well - I've no idea why they needed an I-134 as the I-864A already gave her permission for her income/assets etc to be counted to meet the financial requirements - I just got her to fill it out and send it in anyway.

Mailed I-751 application on 07/14/2009 to CSC

I-751 package arrived at CSC on 07/16/2009

Check cashed on 07/20/2009

NOA1 Dated 07/16/2009

Biometrics Appointment 08/21/2009

Touched 08/24/2009

APPROVED 09/14/2009

Card Production Ordered 09/22/2009

Card arrived in the mail 09/28/2009

US Citizen as of 10/20/2010!

I could be wrong but from what my husband told me, he received an OK from NVC to download an fill in the Affidavit of Support. I don't know if it was the I-134 or I-864 but I guess they told him which one to do?

Anyone have more info about this?

I-134 - is also for spousal non-immigrant applicants (K-3). But if your visa category is CR/IR, then it should be the I-864 for filing the affidavit of support. Please try to verify again with NVC your visa category. Good Luck.

Thank you everyone for your replies :)

I'm still no nearer to finding out just what has happened, but I plan on emailling NVC about it and finding out what has happened. My husband probably wasn't clear about what visa he was doing when he informed them. I was just taken aback when he informed me it was an I-134 :\

Althought it should be I-864 for immigrant visa and I-134 for non-immigrant visa, sometimes certain embassies will ask for the other one for some reason. It seems they all operate sort of independently and some are a little out-dated even and may be just doing it the way they always did (whether correct or not).

Wife's visa journey:

03/19/07: Initial mailing of I-129F.

07/07/11: U.S. Citizenship approved and Oath Ceremony!

MIL's visa journey:

07/26/11: Initial mailing of I-130.

05/22/12: Interview passed!

Well, found out the REAL story... Mother-in-laws are great, appreciate them, especially if you have a half-brain husband x.X

I was able to quiz her about it, and what they filled was an I-864A. Gah! MEN! Immigration is a headache enough as is x.X

Well, at least this question is out there now in case someone else quizzes about it. Thanks for all the help :) *yes, that is his smug smile in my icon :P... he's giving me it now over the internet :P*
