We filed a joint petition in May 2019.  Divorced however in April 2021.  Since the divorce I have been reaching out to the office that has jurisdiction over my case as of Jan 4th 2021 and they told me to bring the divorce documents to the interview and to just wait for when the interview is called.  Has anyone else been in a similar situation?  I know if I had gotten divorced prior to applying for the removal of conditions that I could have applied under the divorce waiver.  However I am approaching my interview for the joint application hoping it would change to divorce waiver.  Any advice from someone that is familiar, or went through something similar?

You will need to request USCIS to convert your joint i751 to a i751 devorce waiver case. You should send a letter to the USCIS office handling your case requesting to convert your i751 application to the address of the USCIS office handling the case (the address in your latest notice letter from USCIS). It looks like you may have done that already, if so great.

 

Bring the letter requesting to convert your i751 case to a devorce waiver case to the interview, and give it to the officer. Bring your final devorce decree and evidence of a bona fide marriage proof up to time of separation.

 

You should expect that your case will move ahead okay with a devorce waiver; they are routinely approved with adequate evidence.
