Hello all

I am both an American and Canadian citizen living currently in Russia with my russian wife. I have a job offer back in the States and Id love to apply for DCF BUT the American embassy in Moscow has almost nobody working there now(some conflict with the US). So,, what are my chances? how can I bring my spouse as fast(yes,,i know there is nothing fast with uscis) as possible.?

DCF if available would be far the fastest route. Otherwise a regular I 130

18 months or so currently, things may change.

 

Have a read of the I 864, several component parts.

I am 57% sure that you must be a resident of the country you DCF in, not (just) a citizen so I think that rules out Montreal. And I’m not sure where Mexico comes into play.

i am a resident in montreal. and since mexico is the office that deals with the us embassy in montreal thats why im asking.

Question -  how are you living in Russia but also a Canadian resident?

 

Canadians have to go to Mexico for their immigration interviews?  When did this happen?!?

1-i live in Canada but hold Permanent Resident Visa in Russia(just by being married to my wife) its quite easier here in Europe getting visas for your spouse  than in America(hopefully theyll change it someday)

 

2-according to what ive read,,,when DCF its the US embassy in mexico the one in Charge of this(or maybe ive misread).

To do DCF in Moscow you would need to have residency in Russia. To do it in Mexico you both would need residency in Mexico.  To do it in Montreal your spouse would need residency in Canada.   USCIS allows the consulates to determine if the Consulate will accept DCF.  The few international USCIS field offices that remain do not process I-130s.

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

The Consulate decides if it has sufficient staffing to process the I-130, but once they decide that, they then seek authorization from USCIS to actually accept it.  They can't just decide to accept it without contacting USCIS.  (The exception to this is for overseas military personnel -- USCIS has granted the State Departent blanket authorization to accept their I-130s.)

i have resiency in Russia,my wife also lives here. But the US embassy in Moscow is half closed so I wonder where I can apply.

 

Im reading good things about the US consulate in Frankfurt..I think I could gain easily residency in germany with my wife(since i hold a eu passport and residency is automatic for me and my wife in any eu country).

You are a citizen of the US and Canada and an EU country? Three citizenships? And by the time you and your wife move and gain residency that is a bit of time. You need to show urgency for DCF so this would sort of be shooting yourself in the foot.

you can have 20 citizenships if u want i dont see how that is surprising 🤷‍♂️.(mom is austrian so i got that from her, then moved to the US got that one and also Canada)

I can move to germany tomorrow and gain residency same day so "not a bit if time at all". 😊 and 👇

I have a job offer from the States so that applies to DCF.

You would need to be a resident for 6 months or more before even asking if they would accept a DCF case in Frankfurt, and then they would only consider it for "exceptional circumstances."  If you have a current job offer from a US employer, are they willing to wait that long?  Even if you move to Germany today and they accept a DCF in Frankfurt after 6 months, you're looking at 8-9 months at least, maybe longer.  I recommend just filing a regular I-130 for a spousal visa, 1-2 years to complete the process.  It could be even faster if you ask for expedites based on the US job offer, first at the USCIS stage (for petition approval), then at NVC stage and interview (consulate/embassy) stage as well.  Others have done this and been approved for the spousal visa in less than a year.  Good luck!
