I am trying to calculate the earliest date we can legitimately file for Marina's removal of conditions and at the same time in time to beat the July 30th rate increase.

Her card expires 10/25/07, so it appears that if we file Saturday July 28th that we will be within the 90 day window. The rate increase memo's from USCIS state that the applications must be filed or postmarked prior to the 30th to qualify as prior to the rate change. We plan on stopping at the post office Saturday morning the 28th to drop off her package at the USPS for overnight delivery to Nebraska.

Are my calculations correct??

My husband's card expires 10/25/07 also...Is there any reason in particular that you are not filing before the 28th. I was wondering the same thing as you and trying to make sure we don't file too soon. I'm not sure where day 1 starts (in the 90 day window). Where do we start counting from? Is July 25th day one or is July 26th day one?

Depending on what day 1 is, the date to fle would be either the 27th or the 28th seeing that both July and August have 31 days.

If you are filing this petition jointly withyour spouse, you must file it during the 90 days immediately before the second anniversary of the date you were accorded conditional resident status.

If your GC expires 10/25/07, then the second anniversary referred to in the instructions is on 10/25/07. 90 days immediately before the anniversary would then start on 07/27/07 which would be day 1 with 10/24/07 being day 90. If day 90 is supposed to be the anniversary date itself, then you'd file 07/28/07. Since from a filing fee perspective it won't make a difference, I'd chose 07/28/07 since that falls indisputably within the 90 day window.
