Travel with AP and unauthorized work

Hi everyone! Long time lurker, first post.

My husband just got his EAD a couple of weeks ago (finally!!!), and it includes AP too. He originally entered with a B2, and as he was not planning on staying, had a job when he got here (since pandemic, he has worked remotely).

When we decided to AOS, we even asked our lawyer about continuing working, and she mentioned that it was authorized work, as it’s for a foreign employer, and he gets payed in his country.

After reading much info here, I realized it was not authorized work. I am a US citizen, so it should be forgiven, and we will disclose it at the interview (we marked no on the original i485, we didn’t know it counted).

Anyway, fast forward to now: he just got a new job with his EAD, quit his old one, and wants to travel back home to see his family. He would also be going to return his old job’s computer and sign his resignation.

Will this be an issue when returning with AP? He never overstayed, no crimes, no anything.

Also, he will be returning vi a Tijuana, a land border, as we live in San Diego and it’s just easier. I hope he is considered “essential” for land border crossings. I won’t be able to travel with him, but if necessary I can drive and pick him up (which would be a hassle, as the CBX is much more convenient hahaha).

Long first post hahaha, thanks for the input :)
