Divorce with I751 Pending

Hello VJ community. I have a situation with my marriage. Been married to LPR wife since 2016. She arrived on 2 year visa in May 2017. We applied for I-751 in April 2019 and have been waiting since then. Our marriage was fine through  the entire process. Long story short we had a disagreement in June that boiled over in July when she decided to leave me.

 

Since then I've tried to reach out to her to reconcile but she wants nothing to do with me. Yet she is still awaiting interview/approval for the I-751. I read up on the process of what you have to do when divorcing while waiting for approval on removing conditions and am well wrote on the divorce waiver process. But she has no proof of our relationship together. I have everything of documentation other than pictures. I've been trying to communicate with her that if she goes through with the divorce then she will have to send USCIS evidence that our marriage was and is bona-fide and in good faith. And that when she is interviewed she must show proof of these things as they will ask why she divorced me. And I've never hit her nor cheated on her. Nothing of these sorts. I have no financial problems  or anything like that.  Just 1 disagreement led to this. But she won't listen to me. She has a probono lawyer that she has entrusted her application with.

 

If there is anybody in the community that might have a similar situation can you tell me how it played out for you.

My advice is to move on, and seek happiness for yourself.  Unfortunately, marriages sometimes fail.  It sounds like she is moving forward with her own removal of conditions.   At this point, her gaining citizenship as soon as possible might be a good thing for you since you are obligated (I-864). I hope you find peace soon.  Good luck.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Many have faced this issue

if she has no interest in reconciliation , divorce and move on

Let her do her own ROC 

pray she has a job and works 40 quarters or becomes a citizen so u are off the hook for the I 864

you are not under any obligations to aid in the ROC 

Frankly if u did nothing to add her to any accounts and make her a real partner,  i can not blame her for leaving

marriage is a joint commitment

Hello. Yes we have accounts together. We had a life together. She just chose to leave everything. Her divorce documents says she wants nothing from me. It's all her decision what is happening

If u have accounts together,  her lawyer can get copies of these 

u do not have to 

divorce ,  move on,  find happiness 

and sorry u go thru this after doing so much to bring her here

Then, that means it should be a quick and uncomplicated divorce.  It might be time to be thankful, and move on.  Good luck.
