Can i filled spouse visa even same sex marriage is not legal in the Philippines

yes paula is correct, if you wanna take the spousal visa route then you need to marry in a third country. Any gay marriage ceremony done here, is never legal in the Philippines, so it will just be useless if I may say, better to go to a country where gay marriage is legal as the US will honor it as legal too. Thank you giving me a full details. Cause i don't want to waste money if it will not be granted. So fiance visa is the key to get her here with me in the United States.

We were just wondering cause I've since some same sex relationship get marry in the Philippines but i know its not legalized. Im just trying to a find to way getting my gf in the Philippines. Cause our plan was fiance visa but i haven't been visit the Philippines after 2017 cause of the Pandemic. I am planning to visit her next year. And that's where i was thinking if i could file a spouse visa if we get married in the Philippines. Since it's going to be a waste might as well stay on the fiance visa. Another question if a filed a fiance visa is her minor child will travel with her going her?

Whether you file for a fiance or a spousal visa, you will still have to physically meet before you can file either one.  I think a spousal visa is superior for several reasons.  

Every couple has their own priorities, and each couple must decide which visa is better for their situation.

K-1        
    More expensive than CR-1    
    Requires Adjustment of Status after marriage (expensive and requires a lot of paperwork)    
    Spouse can not leave the US until she/he receives approved Advance Parole (approx 6-8 months)    
    Spouse can not work until she/he receives EAD (approx 6-8 months)    
    Some people have had problems with driver licenses, Social Security cards, leases, bank account during this period    
    Spouse will not receive Green Card for many months after Adjustment of Status is filed.
    A denied K-1 is sent back to USCIS to expire
  

CR-1
    Less expensive than K-1    
    No Adjustment of Status(I-485, I-131, I-765) required.    
    Spouse can immediately travel outside the US    
    Spouse is authorized to work immediately upon arrival.    
    Spouse receives Social Security Card and Green Card within 2 or 3 weeks after entering the US    
    Opening a bank account, getting a driver's license, etc. are very easily accomplished with GC, SS card, and passport.

    Spouse has legal permanent Resident status IMMEDIATELY upon entry to US.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

@Epic15 Have you looked at a Utah Zoom marriage, which will be cheaper than getting married in a third country? If you are a dual US-PH citizen or former PH citizen, you can fly to the Philippines, meet with your fiancee, get married online with the Utah County Clerk, and get a Utah-issued marriage certificate which has been proven to be accepted for immigration.

 

Also keep in mind that there is an enormous backlog of fiance visa cases at the US embassy in Manila. People who filed fiance visas as far back as 2019 are still waiting for interviews.

Normally K1 visa are approved much faster than Spousal visa. Most choose to so a K1 Fiance  Visa for the Philippines. Yes her minor child can go as long as she is petitioned.  

 

Now with COVID it a different story, but overall K1 is a much superior due to it being so much faster processing time and approval

I don't see much of a chance of you getting into the Philippines next year, I think they will be closed for tourism until 2023.  They have no success dealing with Covid in the Philippines.

I have know numerous guys who have and the lion share always choose K1

Irrelevant.   It doesn't mean they didn't regret that choice later.  I have seen many members who filed for a K-1, then regretted it later.  I have never seen a single spousal visa couple wish they had filed a K-1 instead.  I'm out, Joe.

K1 is much faster and most choose it for that reason

Can we do that do a zoom marriage in Utah? I was former PH citizen i just got my Us Citizen last year. I've been researching that spouse is way fast than the fiance visa. Let's say if we do the zoom marriage in utah so should i file a spouse visa i mean how this works. Im finding ways that she could be living with me in the United States so no more ldr. Plus she has a 13 year old daughter how is that included to come too?

The Utah Zoom marriage could take place while you are both together in PI.  You would be legally married in the state of Utah.  Then, you would file an I-130 for your spouse and an I-130 for the Daughter......that begins the spousal visa process.

Yes, you can. @John & Rose created the thread below about his stepson, who is going to do the Utah Zoom marriage with his Filipina fiancee very soon.

 

John is also knowledgeable about bringing stepchildren to the US, because that's what he did with his Filipina wife and her two biological kids.

Well im in the Us. I was going to file it here in the Us but pandemic came in so i delayed. Then i saw this marriage in the Philippines. Thought of getting marry with her in the Philippines and file for spouse visa. I was bothered cause of i know same sex is not legal in the Philippines but i saw that they have marriage certificates. That's why im so confuse where or what to do just to get my gf and her daughter here with me
