Hi all,

 

I submitted my AOS packet a few days, to adjust status from a K-1 visa (I moved to the US from the UK in July).

 

I've today realised I missed a checkbox on the I-485, for ethnicity (see attached image). I should have checked the box for "Not Hispanic or Latino", but I overlooked it.

 

Will this impact on my application / processing times?

Not an issue.  Relax.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Thanks for the replies both! Could one of you kindly elaborate on why it's either a) not an issue or b) grounds for RFE?

The reason you’re getting different responses is because it just depends on the adjudicating officer. Some will let it slide and others won’t. You will either get an RFE or you won’t, there’s no way to tell. On our I-129f petition we also forgot to mark a box and we didn’t get an RFE while others who missed the same question received one. You’re just going to have to wait and see.

Yep, exactly.  I don't think it's serious because these biographical questions are usually optional.......but, as you said, it could go either way.

If the question wasn’t considered important it would not have been asked.

Those questions aren’t optional for immigration as they are used for background checks.

Impossible to say if it will come up later in the process or not. If you receive an RFE for this then you're ready to send in a new form/page with the correction, you send it in as soon as you have received your RFE and the case won't be much delayed at all. If you delay sending in the RFE response, your case will be delayed too.

You won't get an RFE. At the max they would ask you that when you go for the biometrics.

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete
