SEPTEMBER 2021 NVC SUBMISSIONS

Timeline

I have submitted Fees and Documents to NVC on Sep 29th for my IR5 parents case. So I am part of this thread as well. Look forward to get documentary qualified status soon for all of us.

My last document was submitted September 7th. Got 3 FE review messages today. All the documents we originally submitted were accepted. The FE reviews were:

1. Submit every 2020 W2/1099

2. Message saying the case doesn't meet minimum income requirement. (We already knew this and had already submitted proof of assets, these proofs we're accepted, total value is at least double the necessary amount)

3. Submit evidence of income (I'm self employed)

 

I don't have any W2's but I do have one 1099 which I'll submit, wish they asked for this originally. Not really sure how to show evidence of self employed income, that's why we submitted proof of assets. Guess we're back at the end of the line regardless.

Hi Lee,

Great to hear you got reviewed, sorry to hear it was a RFE. The request for all W2/1099 for most recent tax year is a regular RFE, even if you submit the transcript or have no W2, they want seem to have a check box that needs addressing, if there is no W2/1099 you need to submit a signed statement to say so etc. 

We initially thought of using assets and were advised against this by our attorney, he said the NVC are trained to primarily look for income and qualifying based on assets is much harder, as you need to show using them would not represent a undue hardship etc. So we found a joint sponsor which is much more common path towards qualifying.

N-400 Application for Citizenship

  • 16 Nov 2024: Submit N-400 Online and receive receipt notification

Sorry to hear about the RFE. Our last doc was submitted Sept. 8th, so this is hopeful that we are getting very close. I'm also self-employed and don't meet the income requirement and don't have W2 or 1099, so a bit nervous hearing your experience. I did upload bank statements, signed a letter stating my situation and have 2 join sponsors.

 

Some people find they get reviewed quickly after an RFE and others back to the line. Hope yours is the former.

I'm guessing you're just a day or two away from review. Seems like a lot of requests for W2/1099 lately so I wouldn't be surprised if they request it.

Maybe we should have gone the joint sponsor route.. It seemed like adding a joint sponsor adds a lot of variables for mistakes so we avoided it as our proof of assets it pretty clear and easy to prove.

yeah i initially thought so too, but our attorney's advice was that the opposite was true, going the joint sponsor route is a common path that the NVC are well versed with reviewing, the asset route is more difficult, and containing more pitfalls and delays. 

 

you said earlier that your assets were at least double, I'm not sure where you got this standard from, my understanding is that the requirement is 3 times or 5 times the poverty guideline for your household, (see here) depending on your circumstances, even then there a number of conditions the assets have to meet like being liquid, and being able to move form foreign country to US if they are abroad, and the requirement that it doesn't impose hardship on the person if they are used etc. 

 

There's a few threads on here with people who have struggled to meet the asset requirement due to their stocks / home not meeting some assessment criteria. if you do a few searches you should be able to find them. 

 

Again I really hope you hope you get it sorted soon, and are successful, I will not keep this conversation going as we'll digress further from the main point of this post, feel free to open a new thread in this forum which will be seem by more people, and will be the right place for a discussion.

Oh my gosh! This is great news. We are so close, our final submission was 14/15th Sep.

 

Have been seeing a lot of 2-10th Sep DQs lately so this movement makes a lot of sense.

 

Hopefully this time next week will we hear something, fingers crossed! Good luck everyone, it’s finally our September time 🥳

We submitted all our documents to NVC, 20th August 2021 and Still There, now they are reviewing docs sent on september 7,  did they forget about us?
