My wife got a divorce 5 months now and we just got married and she went back to usa can she apply for my visa there now or we still have to wait

If her US State has a waiting period she was not free to marry. This can be an issue as it seems she married as soon as she filed.

Met 6 months ago, filed for divorce, in less then 5 months she's remarried. THis will be a tough one

 

I'm starting to think she has a waiting period and why he seems to think she can't file for a year.

She was married before so she didn't need to work so she didn't pay any taxes but after she got a divorce . She start work and now she married to me 

And she started to pay  taxes for work 4 months ago that's when she started work also 

But they ask in the nvc about last 3 years tax returns . So we not gonna gonna find a problem with that . Are we  ??

Because she didn't pay any taxes before she worked . Not because she didn't want to but because there was nothing to pay . But now she work and pay her taxes since 4 months now . But they ask about last 3 years tax returns 

 So that's the situation !!!!

its going to be about 2 years before u get to interview so she will have tax returns for 2021 n 2022/ they ask for 3 but look at the present income (year u interview)

she can get a joint sponsor if income is not high 

but u have other RED FLAG  issues

like seems she married on 1 st visit to meet u

u only talked online 6 months before marrying 

in all i read she needs a stable income to support the spouse visa,  she needs to spend more time with u,  as u are going to have to convince a CO at embassy that u are truly in love and not just green card shopping 

 

Please get her to join  this forum

if she relys on Facebook or youtube she will get the wrong information

Due to the Texas mandatory 60 day waiting period, the absolute quickest that a divorce can be finalized is 61 days  

That is for judge to sign

 

Then there is a 30 day waiting period to remarry

so,  she waited the 5 months as she had papers to marry in Morocco or they would not have approved the application to marry/ Morocco is fussy about documents and has to see originals 

 

 

but her issue is income as she just started working and it could be she indicated to him it would take her a year to file / without her imput ,  hard to say

personal message to me 

that's why i quoted Texas laws

 

trying here just to explain the situation to him from CO standpoint

she just starting working so getting vacation time to see him again is doubtful/  she didn't work while married to the other

so little time together in Morocco is hard on any interview

and marrying on 1st visit after talking only a few months????   not good

this is be a hard road to overcome

and even if they are just 9 years apart,  if she can't have children ,  its a big deal too
