My wife got a divorce 5 months now and we just got married and she went back to usa can she apply for my visa there now or we still have to wait

My wife got a divorce 5 months now and we just got married a month now and she went back to usa . Can she apply for me there so i can come live with her  or she have to wait a year to do so 

Because i heard that she have to wait for a year to pass since the previous marriage. before she can apply to bring her current husband  to the state

Give us some more info:

  • How did your wife get her US Citizenship? Was she a US Citizen by birth, or Was it via her Ex-husband?
  • What is her ethnicity? Is she Moroccan? 
  • Is there any age gap?
  • Does she have children? If so, what's their age?
  • Is this your 1st marriage?
  • How many times in the past did you meet her? Was this 1st visit?
  • How long did you know her before marrying her?

 

Morocco is one tough embassy. The more info you provide, the better folks can help

She is american  by birth . I met her 2 times and each time we stay together for 20 days or longer . I known her for 6 months before marrying her . There is 9 years age gap

If there is a wait period it would be before she can marry not file.

or to a USC like her?

 

9 years is not as big an age difference for visa from Morocco

and it is good she did not marry the 1st visit

 

she can apply as soon as she has the original marriage certificate and a certified English translation 

 

Now to really help u

1.  she should join the site and follow the Morocco portal 

2.  she should do a timeline so we can follow the case progress and advise her on any issues she may have

3.  it will be 18 to 24 months to complete to the interview for your visa if u r approved

4.  she should try to visit you again before the interview

5.  she should save boarding passes and proofs of each visit

5.  u married this year (and this is very important in Morocco) so she needs to fill as married and add u to her 2021 tax returns

please tell her to message and ask how IRS says to do this / important that when married to a Moroccan , we show we have started to commingle fiances

 

and Congratiulations

 

Practice your English skills

and learn how to drive before u leave Morocco as driving lessons are expensive here so help her save this expense

She was married to a USC btw

And we already have our moroccan marriage certifiacte

So we don't have to wait for the year to pass since the previous marriage to apply for uscic ?

 

Is there any process we have to do to make that marriage Recognized in america  too ?

You do not have to wait for anything 

you are now married to american and she can apply

she needs to read the information on the USCIS site or the guides above to do the petition properly so immigration has the correct documents

it saves helps to do it the right way

and do not depend on Facebook or youtube for information  as it is often wrong

I married in  Morocco too

when a country certifies the marriage is real it is accepted in the US

good thing to clarify 

when marrying in Morocco , the judge who prepares the papers always asks about past marriages and they have to have the original divorce papers /Morocco keeps originals of all US documents including these and birth certificate

so, your USC wife should get new court certified copies of her divorce and birth as u will need them at the interview (she has 2 years to do this but get them ready

 

and again,   please tell her to join us here (she can use your account and ID herself ### the USC or make her own Profile )

but its more important as she has to do all the work now,  that she does it right

Because we were already talking at social media for almost 5 months and during that time we decided to get married and at her first visit she brought the documents for marriage with her 

 

I noticed ur previous message when u said

she needs to join VJ so she can learn how to overcome that and any other issue the embassy sees as a problem

 

Frankly you met and married too fast and did not take time to know each other 

US Casa embassy says this about fast relationships

 

Some of the signs that an Internet contact may be developing a relationship with an American in order to obtain an immigrant visa through marriage are:

  • Declarations of love within days or weeks of the initial contact;
  • Proposals or discussions of marriage soon after initial contact;
  • Requests to the American to visit the foreign national’s home country soon after the declaration of love or proposal;

Do u have any info concerning the nvc process when they gonna ask about last 3 years tax returns and tax transcripts 

So the situation is 

She was married before so she didn't need to work so she didn't pay any taxes but after she got a divorce . She start work and now she married to me 

And she started to pay  taxes for work 4 months ago that's when she started work also 

But they ask in the nvc about last 3 years tax returns . So we not gonna gonna find a problem with that . Are we  ??

Because she didn't pay any taxes before she worked . Not because she didn't want to but because there was nothing to pay . But now she work and pay her taxes since 4 months now . But they ask about last 3 years tax returns 

 So that's the situation !!!!
