Hello everyone, because of COVID my mom overstayed her Tourist Visa and I would like to petition her before she leaves back to our home country. 

 

I am trying to put the package together 

- I-130

- I-485 

- I-693 Medical Exam 

- Birth Certificate 

- Taxes 

 

I plan on mailing everything to TSC since we live in Texas. 
 

Does this looks correct? Has anyone done this process before. Please share your experience.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Do NOT mail the package to the Texas Service Center.

Understand that once you file the I-485 there will be no "returning to her home country" until she received advance parole or the AOS will be considered abandoned. She must remain in the US until she receives either advance parole or her green card. My understanding is AP is taking about 8 months.

Good point.  Note that the OP didn't have an I-131 even on the list.  That's why I listed it.

Hello, 

 

My mother arrived two weeks ago to the US, she had already overstayed her visa last year because of COVID, she returned to the US and she didn't have a problem. Now that she is here I am still convince that I would like to do an AOS for her, I did my naturalization process online and would like to do hers as well but the website doesn't have all the forms that I need, has anyone done this process online? Also, do we have to wait for the 90 days as "Trump's 90 day rule" states?

Mexico Border, Mexican Nationality, she normally resides in Mexico, she overstayed her last trip because of COVID. We understand that we the AOS she will have to stay until the process is complete and also will apply for parole in case of an emergency.

Does she live by the border? Did she enter through a land point of entry?

Yes Mexican nationality, she lives by the border her trip in 2020 she entered and exited by land she just arrived two weeks ago and it was by plane because the land border is closed. The plane was from a border town in Mexico to a border town in USA. 

The was no restriction in place for Mexican nationals to enter their own country, so there was no reason for an overstay. 

Did she get a paper I-94 permit before her 2020 trip?

No, since it is by land they only scan the visa when they enter and there is no record when someone exits by land. This time she got a I-94 because she traveled by plane, which gives her a permit for up to 6 months.
