Hello,

My fiance is from Oman and during her interview, she was given a 221 (g), stating the TWO reasons/requests:

1. Request for original divorce cert.

2. Request for joint sponsor.

 

During the interview it was stated by the consular, that I (the petitioner) didn't provide/make sufficient income to support the number of dependents included in our petition. . However, this was not included on the 221 (g) form even though it was expressed verbally.

 

Later I received a letter from the same consulate stating,

 

 

"Thank you for your email,

Her case was send to NVC for revocation, please contact USCIS for the status.

Regards,
Consular Section "

 

 

I have checked the status on the USCIS website (which hasn't updated as of yet). I have also contacted them by phone and they told me that it would take 180 days before I would receive a response by mail. I have also checked the case status on the NVC/CEAC site and it states simply, "Returned to NVC." I have also sent them a message via online forum, seeing that they do not respond to emails now.

 

Now my questions to anyone who understands what my fiance and I are facing; What should/could be done now other than waiting for the letter/reason(s) for revocation? Also, does "Revoked" mean that we will definitely need to re-file another K-1 fiance visa case if it is not such a response (reason for revocation) that could be appealed? And if so, how long could an appeal case take? Quite possibly it could be a better idea to just move forward and re-file another K-1 petition?

K1 Petitions sent back to USCIS are not re-afirmed. You need to refile the K-1 remembering that that meeting time restriction is still applies.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

How did u send the info for joint sponsor

many send it without the important info as to the case # and info

all documents sent should be labeled with Case # ,  both names of petitioner and bene and Both DOB's

then NVC or embassy knows where to attach the incoming files 

 

As Paul and Mary stated K1 are sent back and it would be at least 6 months to get a notice but most of the time , there is no notice as it was given to bene (221G)

so,  you can refile or marry and file as spouse

 

And embassy like the originals for divorce,  etc

The embassy is not obligated to accept your joint sponsor.

Not sure what you didn't understand here -  the statement made by the consular officer directly relates to reason #2 for the section 221 g.

 

Was the original divorce decree included with the petition?  And if so, why did your fiance not take it to the interview?

To clarify, after the interview our K-1 petition was sent "back to the NVC for revocation" (sorry, my post is somewhat lengthy). So now we obviously still want to get married, so we would like to know what we should do next? Should we go ahead and re-file or should we wait for the reason for "revocation," and then re-file? In other words, are we waiting for a reason for revocation or is there still any hope for our existing petition?

During her interview she took the certified copy and not the original. We were of the understanding that she didn't need to bring original.  . However, after the interview they gave a 221 (g) stating the two items that they needed, which were the original divorce certificate and a joint sponsor. We provided both and later received the email concerning the revocation.
