Married to USC. EAD renewal delayed and working.

Hello everyone. How are you all? I hope everyone is fine. I filled my concurrent application i130, i485 and i765. It's been 10  months already for the EAD and I still don't have it. But I was working on OPT before my adjustment of status and waiting on my EAD renewal on c09 for almost 10 months. I have done the biometrics recently. I have a questions?

 

1) My brother in law who's sponsor me on i864a earns less money and I want to include myself as a supporting household member as an intending immigrant to include my income on the sponsors i864 (which is my wife in this case) but I am waiting on EAD renewal and working a job making 54k annual paying all the taxes, but it will be forgiven as per uscis policy manual. So can I include my income? The dhs is going to come after my employer and fine him for hiring me on my i797c and I already surpassed 180 days afrer my OPT expiring date and waiting on EAD renewal.

 

Please help me. Thank you
