Hi. I was divorced year 2002 and I only have a photocopy of my Divorced documents. Is it possible to use the photocopy of my Divorced documents or should I get the original for filling Fiancé Visa. I lived  in Philippines and It is difficult to fly back  in the US to get the Original copy especially now there is covid. Thank you for your help. God bless and be safe everyone.

Greetings!

Take your photo copies and see what they will say, as usually they would want to see the original. And whilst waiting I would highly suggest to request a copy of your divorce decree through a relative or a friend and have it mailed to you in the Philippines (FEDEX,so it will be fast).

Also, you may start applying a Certificate of Legl Capacity to Marry or produce and affidavit that you are legally free to marry and have it notarize.

Thank you for the information. We have a photocopy of California Divorced Documents. Do we have to go to California to get the original because we are in Cebu, Philippines.

I would try to reach out to the court the processed it. They can probably send you a certified original.

Copies are fine for filing, you only send in copies anyways for filing

From my experience USCIS doesn't want originals only copies, and at the fiance interview in manila they have never asked me for certified copies so they don't really care.

Now of days most courts can email and or mail you certified copies for a few dollars.

In California, divorce records are from the Superior Court in whatever country it was in.  Each country has their own system but like San Diego County where I got divorced you can pull the case up online.  You can at least get the case number and often you can buy entire online copies.  Certified paper decrees by mail they request a self addressed stamped envelope.  I'm speculating they would agree to a prepaid FedEx lable they could just print.  Other counties in California may be more or less available online.  As a general rule all the courts around here have been very flexible and accommodating for record request by mail due to this chironavirus, since they are going out of their way trying to keep people from coming in and lining up in their records office to get court papers.
