Applying for SSN with Form I-485

Hello,

 

I am trying to plan ahead and would like some advise on how best to go about getting a Social Security Card for my fiance after we are married.

 

I will obviously be filing an I-485 form and on that form, there is an option to have USCIS contact SSA and give you a SSN and card once the I-485 is approved.

 

Is the best/quickest way to do this? Am I better off applying for an SSN separately rather than stating I would like to apply for one through the I-485?

Do it separately ASAP after she enters the US and before you marry:

If when filing I-485 she is already assigned an SSN (after following my advice above) then input it in the SSN fields. If she'll have a new married name after you marry then and answer "Yes" to both #14 and #16 and her "Current Legal Name" would be her new married name. Do the same for the similar questions on I-765: https://www.uscis.gov/i-485

Filing Forms I-765 and I-131 with Form I-485

If you submit Form I-485 and pay the required fee, you do not have to pay an additional fee to also file Form I-765, Application for Employment Authorization, and/or Form I-131, Application for Travel Document, for advance parole. You may submit these forms together. If you choose not to file Form I-765 and/or Form I-131 with your Form I-485, then you must submit a copy of your I-797C, Notice of Action, (also known as your receipt) as evidence that you filed Form I-485.

She can get a SSN during her first 76 days in the country. Then the window closes until she has EAD or the greencard approved…a long time. You don’t have to marry first.  She should get it in the name on her I-94 because that’s how she will be listed by USCIS (the name she entered with).
 

Even if you do marry first, don’t try to get the SSN in her married name. It doesn’t work because USCIS records only have her maiden name at this point.  Her card name has to match USCIS. When she gets her EAD or greencard, USCIS will have her married name because she applies for AOS in the married name (if she plans on taking your name). At that point she can go get a new SS card in the married name. It’s the number that counts and not so much the name at this point.  
 

The trick is getting an appointment with Covid restrictions. Here’s the current info. It may change.
