I'm sorry that you guys have hit this problem. I was very confused about which code to put when doing the paperwork, and wouldn't have done it correctly had I not read about your issues here.

Most worse thing for us is that we catch our expensive lawyer to fill out the papers wrong. Thanks god I have so much time to study immigration laws and in time to maybe change the mistake :huh:

I just realized I made this same mistake on my wife's I-765. :crying: I used the code (a)(6) instead of ©(9). She entered the US on July 3 with a K1 visa, we got married on August 19, and filed the AOS and EAD (I-485 & I-765) applicaions together on September 6. Our NOA date is September 20. Obviously (a)(6) was the wrong code because her K1 visa expires on October 1.

What should I do now to avoid additions delays in getting her EAD? Should we wait and see what happens, or maybe refile a new I-765 now with the correct code and explain the mistake? Or is it likely they will notice the obvious mistake on the original application since it was filed concurrently with the I-485, and still process the EAD?

Has anyone else made this mistake recently, and if so what was the result?

Have you recieved a notice of action on your EAD?

Yep, NOA on the I-485, I-765, and I-131 all came with the same receipt date of September 20.

Ok then I would make an appointment with infopass right away explane for them your problem.

I didn't do this since we had a lawyer and thought he could help since it was his fault.

But I know now that Infopass can be very helpful.

My EAD was denied and we had to refile.

But we couldn't refile before we heard from them.

You can be lucky that they will change the code for you.

Well, we just got her notice in the mail today that the biometrics appointment has been scheduled for October 18. Is that a good sign, or not necessarily?

I'm the one who started this thread and because I found the mistake before we could have been denied - we were lucky. We went to two INFOPASS appointments. At the first one we told the IO about this error and asked to fix it. A week later we went back because my hubby's case hadn't even been updated on-line and the 90 days were quickly approaching (and we were about to go on vacation for 2 weeks). The IO there said that the EAD had been approved a few days before the second appointment....and when the EAD came in the mail it had the correct code AND is valid for a year.

In other words....make an infopass appointment ASAP and you should be fine.

My wife and I went to the INFOPASS appointment today, and it turned out to be a complete waste of time. First of all the appointment was scheduled for 12:30, but we still had to take a number and waited over 2 hours until a little after 2:30 when our number was finally called. What is the point of INFOPASS if you still have to wait such a ridiculously long time?

So I explained to the Immigration Officer that we had filed the I-765 about a month ago along with the I-485 to adjust status. I told her we just realized that we had put (a)(6) in box 16 instead of ©(9). She looked on her computer and said "Yeah, you're right. You're going to have to send a letter to the address on your NOA to explain what happened and ask for it to be corrected, otherwise they will reject your application." Then I said "Isn't there anything you can do here?" She said no. (Then I wanted to say "Why don't you put your little fingers on the keyboard and correct the mistake for us so we don't have to go through all the hassle and wait of mailing in a letter that who knows if it will make it to the right person/place in time?" but I held my tongue.)

We waited 2+ hours in the lobby to have this little 1 minute exchange with the IO that was of absolutely no help at all! :o

That does not sound like no help at all, its entirely possible she could not change a procedure that is housed by the NBC. You have a chance to get it corrected, and thats the good part! :)
