Oops!! We filed under A 6....is this a problem?

I've been reading a lot of posts recently about filing for the EAD under A 9.

But...we filed under A 6 - because this is what I thought was correct.

Could this be a problem? :help:

Is that why we haven't heard anything and it's been 62 days since we've filed?? I'm worried now :wacko:

It's worthless. They will send you a notice saying it expired when you married.

They will make you refile under the A9 and repay the cost of the thing. I know from a very expensive experience.

that is *one* possible outcome.

I don't doubt that it was an exasperating result, however you were speaking in an absolute result, when it is not.

In the several years I have been a member here there have been quite a few that have made the same mistake. I have yet to encounter anyone have their application corrected for them. They have 1] received an EAD valid for only a few days (because of the I-94 expiry date), 2] had their I-765 application and payment (since the check was submitted separately from the I-485) returned to them as rejected, or 3] received notification of refusal because of the basis requested (a6 instead of c9) and a demand to resubmit and pay new fees.

I don't mean to be a naysayer and that it will never happen just because I have never seen it, but I also don't want to give anyone false hope that it is a "done deal" by simply requesting a correction.

Best of luck to those that are now going through this and hope that the corrections are made for you.

I could send you a copy of my I-765 if you like and see how I f***ed it up, and yet still got an EAD. Trust me, it can happen.

Well, I guess we can't do anything but wait to see what happens....

I did what I could - called USCIS to tell them of my problem and set up an infopass appointment for next week (the earliest time available).

Now we just have to wait...

If they were to give my husband his EAD now it'd already be expired - as of June 16th.

So, I guess if worse comes to worse we'll have to reapply - which pisses me off not really because of the $$ but of the waste of time that I accidentally caused my husband when he'd like to be working :crying: .

I just noticed I put the code A6 as well. I sent it with my I485 as well and should have put C9 on it. Damnit this sucks!! I got the biometrics appointment letter though..should be good right?

I hope (for us too).

As I was in your place - I'd call USCIS and tell them that you made a mistake and ask them to fix it.

We also have an infopass appointment next week to fix this.

I don't want my husband to wait another 3 months for his EAD.

I am afraid that this is what is going to happen for us. We contacted them friday to change from a6 to c9 and recieved an email yesterday that they have send us a notice by mail that a decision is taken. :hehe:

But do you know what the decision was? When I called correct this same error I wasn't asked for my e-mail address - only our address. We're waiting to see if there is a touch, an e-mail, or a letter.

Regardless, we're going to immigration next week - so we'll know something.

No the decision is hanging in unknown right now. I can't take it lol

I am afraid that the postmail today won't give me any answer since it sometimes takes several days until recieve it from them from the day they say they send it lol :blush:

I just hope that other couples learn from our mistakes and don't do the same thing... :thumbs:

I was angry when I realized what happened, but now I know that I did all that I can for now. We'll see...
