Did you post and upload or just post the form?

My lawyer is drafting a response to the RFE as of now. He said it will be ready by early next week. I will do as he advises.

It took 2 days after notification of RFIE to get my letter on my account. I was also so worried till then

Timeline

Morning you all, I hope someone can take a look into my RFIE and just confirm I'm getting this right: 

They're saying

 

1-Based on the documents submitted, we could not determine that the petitioning sponsor, xxxx, on Form I-864, Affidavit of Support, is qualified. In order to be a qualified sponsor, the petitioning sponsor's Form I-864 must be properly completed and signed, and the supporting documents must establish that the petitioning sponsor's income meets 125 percent (100 percent if military) of the federal poverty guideline for the sponsor’s household size.

 

My wife's total income as stated on her 1040 form sums 100k in the last 3 tax years, let's say 30 thousand per year, if by 2020 the 125% federal poverty guideline was 21,550 by 2021 was 21,775  for 2 people, (cause it's only me and her) and for 2022 is 18,310, what's the issue? I don't get this part, form IS dated and signed by her

 

2- You must submit evidence to establish that the petitioner on Form I-130, xxxx, is a United States citizen

this is clearly and oversight cause her US passport is in our online account

 


3- Submit the marriage certificate for the marriage of the USC petitioner

 

After marriage I was sent by mail a certified copy of our marriage license with our signatures, our witnesses', deputy's seal and signature, down bellow it says marriage certificate, we sent that, here in FL marriage certificate per se is only issued 3 months after marriage, they can issue it right now but back then I had to use what I was given since I didn't have choice 

 

Please enlighten me

Was your wife's current annual income (so the most recent year) above the 125%?

On last tax year 30,687; no tax amount for this tax year yet, we'll do them this weekend, would it be a good idea to upload those too? She's in the 43,000's on them

So, two days ago I recieved an email about a action has been tacken.

Today I got the scanned letter in USCIS myaccount, still waiting for postal letter

 

So, they are asking for birth certificate

 

Now, I was born in Pakistan, but I am British citizen. For some reason I do no have my birth certificate

 

Q: Can I submit a secondary/alternative evidence i.e. Pakistani Government ID or Passport instead?

Case background: Applied as spouse to USC, no dependents, no kids, first marriage ever, married since 5 years, we lived 5 years in the UK, a British citizen.

 

(Self-made application - no lawyers/solicitors were used)

you will need a birth certificate. Can you get something notarized from the UK? What did you use to get the citizenship?

Thank you for you reply.

British citizenship gives us secondary evidence options i.e. Pakistani passport which states place of birth.

My british passport also have place of birth 

 

Not sure why you need this

 

So there is no way any secondary document can be used?

Do you have naturalization certificate? BC shows parents name etc. They usually use it to prevent fraud. For example that you are not marrying any sibling or for parents it proves the relationship. Maybe try the naturalization certificate.

British naturalization certificate only has place and country of birth, same as passport. Nothing about perents.

 

Mind, our marriage is 6 years old. We have an approved K1 fiance petition in 2015 (same partner). We just never pursued GC route, and lived in the UK

 

What I do not understand is why they need this, They never asked for this during K1 petition, I submitted Pakistani passport copy during K1 finace petion in 2015

It is a requirement here even to get a passport...

"U.S. Citizenship and Immigration Services (USCIS) requires you to submit a copy of your birth certificate when applying for a family-based green card like a marriage green card. Without the required supporting documents, USCIS will not process your green card". My advise would be to talk to an attorney.

You  need your Birth certificate or Non availability of birth certificate from the local place of your birth. In this case the city you were born in Pakistan. This is non negotiable and no other document can be submitted instead oa BC ir NABC.

Yesterday, I submitted my response to RFIE online

The status changed online changed on the spot to REPONSE RECEIVED AND WE HAVE RESUMED WORKING ON YOUR CASE

 

Is this normal, to change the status?

 

I also have just posted the documents, will be delivered by Thursday

 

I have sent them FRC insteast of Birth Certificate
