Hi, my timeline is similar to yours and just got an RFIE for long form birth certificate. Was wondering if you just resubmitted the original certificate or did anything different. I am a Canadian citizen but was born in India, so they are asking for a Long Form Indian BC. The RFIE wording seems like generic, therefore, I am facing a dilemma where I am not sure if the RFIE has been sent because:

 

1. They simply lost or overlooked the submitted Birth Certificate with my 485 application.  

 

OR

 

2. They actually looked at the BC and were not satisfied with it. 

 

If the issue is 1. , it's an easy fix of re-uploading what was originally submitted. However, the risk is if this is not the issue but rather 2., then I face the risk of a denial. 

 

If this issue is 2., I would like an opinion of the community to see what's missing from my BC. Some information about the BC is mentioned below:

 

1. Title is Birth Certificate (it is a late entry - 9 years from Date of Birth)

2. Issued by Chief Registrar (Birth and Deaths) State Name

3. Do not see any seals

4. Mentions the Municipality

5. Mentions my Name, Sex, Date of Birth, Registration Number, Date of Registration, Place of Birth (Name of Hospital, poor handwriting), Mother Name, Father Name, Paternal Grand Father's name, Permanent Address of Father and Mother (at that time).

6. Handwritten in Red Ink - Late Entry Registration, who allowed it (Registrar - Births and Deaths of Municipality) , order number, Date of Order

7. At the Bottom: Date and Signature of Preparer / Date, Stamp and Signature of Issuing Authority

 

 

 

 

 

Hey bud, I ended up uploading both the long form BC's again (new version and old handwritten one from 20 years back). I included a cover letter with a general explanation of what the difference is and what all is included on the BC's. I also attached two highlighted copies where I highlighted the some of the key fields (the handwritten form could have been hard to read). Other than this, I wasn't sure what else to do - the new version I have is the only one available per my City's municipal authority. If I get RFE again on this, I'll be left with no choice but to upload secondary evidence such as school certificates etc. Fingers crossed.

 

I would say, you should also include a cover page and add in some description. Check with your local municipal office if there is any other version available. It seems your current version already adheres to what they need, per requirements in the reciprocity schedule (so was mine! :( ) https://travel.state.gov/content/travel/en/us-visas/Visa-Reciprocity-and-Civil-Documents-by-Country/India.html

9/07: Submitted I-130 and I130A online
09/14: Received NOA for I-130 in mail
9/24: Mailed I-485, I-864, I-765
9/27: Delivered to USCIS Chicago and signed by Chyba
09/29: Text messages for application
10/7: (2) NOA's for I-485 and I-765 received in mail

10/16: Online status changed to "biometrics scheduled". Bio on 11/09.

11/04: RFE received for Birth certificate

11/05: Uploaded RFE response. Status changed to "we have received RFE response"

Thanks for the suggestion. I might have to explain some of the poorly handwritten stuff by highlighting on one of the copies as well. I did look at the reciprocity schedule and yeah, just like you, didn't see anything on there that my BC is missing. Kind of ironic how they would nitpick small things on BCs and yet send a generic RFE letter by referring to this link rather than explaining what's missing or unsatisfactory on a particular BC.

I also had the RFE for long-form birth certificate (UK) two weeks ago, despite it being included in the packet and scanned by USCIS.

 

I simply responded to the RFE with a new scan of the long-form birth certificate (no additional cover letter). That was 11 days ago and I haven't received any further updates beyond a generic "Response To USCIS' Request For Evidence Was Received".

 

Should I be concerned that my case hasn't updated back to "USCIS is actively reviewing your case"?

I'm in the same boat as you, though it's only been two days. I know its very anxiety inducing but going through a bunch of posts it's a mixed bag if USCIS will update to "actively reviewing" after RFE response. There's a post a couple of pages before from another UK person whose status did change. But there's several who had no update for months and then it went straight to "interview scheduled". I just read this 2 mins ago:

Is it mandatory to send both paper and online response? I uploaded my response to the website but didn't mail it. Curious what others are doing?

I am doing it both just to be sure because I talked to someone who is a mod in a K1 FB group and she told me that the online thing is just for I-130. And since K1s who are adjusting status sent their AOS via mail.

You know, i looked up timelines for cleveland fo to see how long biometrics takes to be scheduled because i was really worried… some had 5, 6 months… i just said to myself that if there are no movements, i’ll info pass at 6 months… all will be ok… worse case, follow up at 6 months… i know it doesnt help and we really all just wait for updates but when you least expect it, it will come. We will continue to pray for each other :)

Hi all, need some advice regarding our recent RFE, which states: "Based on the documents submitted, we could not determine that the petitioning sponsor, [redacted], on Form I-864, Affidavit of Support, is qualified." The language is a bit vague... I can't tell if this means they don't have enough information to determine if the sponsor is qualified or if that their determination is that the sponsor is definitely not qualified. Any opinions?

 

FYI, with the Affidavit of Support, the only documentation we provided was a photocopy of the sponsor's 2020 tax return (not transcript), which establishes earnings in excess of 125 percent of the federal poverty guidelines for the sponsor's household size. In this case, the income is earned from a foreign company, so there are no W-2s, etc. Does this make a difference?

 

We are thinking we will complete a new I-864 and submit tax transcripts (not photocopies) for the three most recent tax years. Will this be sufficient? Or is it better to go way overboard and provide 12 months of bank statements as well as evidence of ownership of personal property (which they suggest to provide if the petitioning sponsor is unable to meet the income requirements). The tax transcripts show evidence of sustained income that exceeds the requirements, so theoretically that should be enough, but we also don't want the application to be denied. Is it best to give them every bit of evidence we've got (short of getting a joint sponsor)?

Did you send proof of sponsor's citizenship?. Like a copy of the bio page of the passport or a copy of the birth certificate?

Because it could be something as simple as that.

Also when I responded to our RFE. We included the full federal tax form as requested. Plus three years of W2s and three years of tax transcripts.

I didn't mess with assets because income was enough to qualify. I resubmitted a new form and again followed all the instructions on the website for the form. Including following the helpful tips page.

Proof of sponsor's citizenship was included but will be sure to do that when submitting evidence for RFE. I'll follow your lead and submit full federal tax form as well as transcripts, and be sure to pay attention to the helpful tips page.

 

Just out of curiosity, did you submit via mail or online? Has your case status been updated since submitting?

We sent it via FedEx. There were too many pagesand documents to properly scan and there were limitations to how many pages I could scan per their upload instructions.

Our RFE response package was received this morning in MO and no change in status yet.

I hear the change in status is hit or miss. For now I wait and hopefully what I sent will cure the deficiency.

I sent a fresh form and reviewed all figures and calculations.

Used a cover page that outlined everything I submitted.

sent both copies of birth certificate and bio page of passport.

Federal 1040 with schedules.

3 years of W2s.

3 years of tax transcripts.

Two months of most recent pay stubs.

Employment letter.

WE sent the docs for REF this afternoon via USPS and trying to upload the docs too online, but we always encounter this error:
No description available.

 

Any Idea what to do? All files are below the 6MB limit. Tried different browsers too but it still shows the same error. Thanks.

Hello, I was hoping I can get some answers here:

 

We received an RFE for my adjustment of status recently.

One of my questions is, my husband is currently unemployed and I’m not sure what documents we need to provide for him since he is the petitioner.

In the RFE it says:

Based on the documents submitted, we could not determine that the petitioning sponsor, <husband>, on Form I-864, Affidavit of Support, is qualified. In order to be a qualified sponsor, the petitioning sponsor's Form I-864 must be properly completed and signed, and the supporting documents must establish that the petitioning sponsor's income meets 125 percent of the federal poverty guideline for the sponsor’s household size. See Form I-864P for information on the Federal Poverty Guidelines.

 

If the petitioning sponsor's income does not meet 125 percent of the federal poverty guideline for their household size, you must obtain a qualifying joint sponsor who demonstrates the ability to support you or submit evidence of assets. See Form I-864 Instructions for more information. If you decide to obtain a different joint sponsor, you will need to:

-Submit a completed and signed Form I-864, Affidavit of Support, from the joint sponsor. All pages must be present and of the latest edition date.

-Provide the joint sponsor's Social Security Number on Form I-864.

-Provide a complete and correctly calculated household size on Form I-864.

-Submit a complete copy of the joint sponsor's Federal income tax return and all supporting tax documents (W-2s, 1099s, Form 2555, and tax schedules) for the most recent tax year.

-Submit evidence of the joint sponsor's status as a United States citizen, United States National, or Lawful Permanent Resident.

 

We also have his dad as our joint sponsor but is retired and owns the house that we are currently living in— we provided all IRS documents w2s, 1040 sr, 1099-r, 8867, 8879, ssa-1099 but it says on the RFE that we need to send them all of these documentation again. They also asked us to include his dads SSN which we did when we filed so I’m a bit confused on out current situation. Any advice or help would be appreciated.

 

Last thing they added was: You have submitted Form I-485, Application to Register Permanent Residence or Adjust Status, and ALL pages of the form are not present or of the same edition date (which in my defense I made sure that everything is properly answered and even put N/A on blanks.

 

I apologize if this too long but I am in need of assisstance.
