Timeline

This is the letter we got with our info blocked out.

All they are asking for is a fresh I-864 with 2020 tax return and W2s.

I will go through the points and add the evidence we missed and resubmit. I do have the 2020 transcripts available now. will add the W2s and considering 90 days of pay stubs since I don't have them for July and August. 

Does seem to just be a deficiency letter.

I'm in a FB group and someone with the same September 15th PD as me already got their interview schedule at the LA field office! That's crazy haha. I'm in Philadelphia where they're still  scheduling April cases...

Application for Naturalization (tbd, Philadelphia Field Office)

11/18/24: N-400 filed online and USCIS portal predicts 7 months to decision

11/18/24: Received receipt notice; biometrics reuse notice; and case status changed to "case is actively being reviewed"

 

Removal of Conditions (tbd)
2/6/24: I-751 packet shipped via FedEx

2/7/24: Delivered and signed for

2/9/24: Text message with IOE receipt number received at 12:26pm

2/13/24: I-797 48 month extension letter and biometrics reuse letter available online, case updated to "actively being reviewed"

Adjustment of Status (5 months)
9/13/21: AOS packet shipped via FedEx

9/15/21: delivered and signed for

9/17/21: 4 text messages with IOE receipt numbers received at 8:45pm

9/24/21: Received 4 receipt notices in the mail and online access code

9/25/21: Biometrics scheduled for Philadelphia, ASC

10/18/21: Biometrics appointment completed for I-485 and I-765 (Code 3)
10/18/21: After biometrics, I-485 and I-765 case statuses immediately changed to "case is being actively reviewed"

10/28/21: I-693 deficiency notice uploaded online, case status still, "case is being actively reviewed"

12/29/21: Interview scheduled. Contacted Emma agent and they said it is on 2/7/22

2/7/22: I-485 approved

2/12/22: I-797 approval notice received for I-485 and I-130

2/15/22: Green card delivered by USPS

What a dream timeline. Utah is not even scheduling this year cases, so I’m sitting tight and getting ready for the longest wait 😂

Looks like they also got an RFE for form I-130 and got it cleared in no time.

I also think the RFE letter has generic language. And maybe some tips on the usual mistakes like to make sure you have a current form and sign and include the SS number.

 

In the original filing we included tax transcripts for 2017, 2018, and 2019 which is all I had available at the time. The 2020 transcript should be available now since I filed in September. 

Then I gave them the 1099 I filed for 2020. No W2. Missed that one.

Also did not include pay stubs.

 

I did include an employment letter. 

 

I have an issue with the 6 month worth of pay stubs and need advice from folks. Although I have been employed over ten years at my company, I was on unpaid leave during the months of May and June 2021. So no income in those pay stubs. I can include 3 months of stubs instead of 6. 

The letter of employment is not enough. Add the last pay you have and W2.

My advice is to read the Instructions for the Form I-864 carefully. Letter of employment and the last 6 paystubs are not mandatory as per their guidelines - You may submit this information for the most recent three tax years, pay stubs from the most recent six months, and/or a letter from your employer if you believe any of these items will help you qualify.

The golden rule for this form: Latest tax transcript from IRS website. 3 most recent years tax transcripts are OPTIONAL.

If you can't provide latest tax transcript, provide the latest tax return including all supporting tax documents.

++ If the current income line is based on the annual salary, provide the employment letter and paystubs. 

 

It would be good to check in which situation you are and provide the supporting documentation and you may also go overboard since it's a RFE.

This RFE is generic, I saw it all over and I think they forward it because people provide every single tax item they have, but it isn't needed.

Sorry I tried to edit my post but it was too late.

I meant I submitted the irs form 1040 tax return. Not the 1099.

In any case. The evidence they are asking for is the completed 2020 form 1040 with all schedules along with the W2 and tax transcripts. 

I can definitely do that.

Will include the employment verification letter and pay stubs for the last three months. So as to not have to go into a long explanation about missing income for the months of June and July 2021.

I can provide all those now since the IRS website has the transcripts available.

I will give redo the form and double check everything.

Make sure the household size is 2 again because it kept changing on the PDF.

I will submit as evidence the completed 2020 tax return like they asked.

Tax transcripts for 3 years (2018, 2019, 2020) now that I have them all.

The employment verification letter.

Just trying to avoid June and July 2021 pay stubs.

That should cure this one.

Omg....dream I wish I was in...everything including an RFE done and cleared. That too in LA..And here I am..still waiting for some movement after receipt ..🙄

Does anyone know if USCIS only starts to review your files after biometrics have been done? I haven't received an RFE or 693 deficiency notice, but it seems like people who've had their biometrics done (and case is actively being reviewed) start to see these. Just curious if they start reviewing before bio or only kick start after bio.

Marriage to USC (H1b to GC)

9/07: Submitted I-130 and I130A online
09/14: Received NOA for I-130 in mail
9/24: Mailed I-485, I-864, I-765
9/27: Delivered to USCIS Chicago and signed by Chyba
09/29: Text messages for application
10/7: (2) NOA's for I-485 and I-765 received in mail

10/16: Online status changed to "biometrics scheduled". Bio on 11/09.

11/04: RFE received for Birth certificate

11/05: Uploaded RFE response. Status changed to "we have received RFE response"

I didn’t get any RFE or deficiency notice myself, since I’m adjusting from K1, I don’t need a new medical exam. But one thing you can do to guide yourself through is to check if the cases around you got RFEs or any sort of movement, that’s one indicator your case is being/ has been reviewed. The IOE cases don’t really show much after biometrics… they just jump straight to interview was scheduled if any rfe doesn’t occur. 
Your case can definitely be reviewed before biometrics, there are people that got rfes before going to biometrics.

Timeline

Today we saw our case had been updated with an RFE for the I-864. The RFE date is November 4, exactly one week after the biometrics appointment on October 28. Going to give them everything they asked for and more to hopefully resolve this ASAP.

 

Does anyone know if they can issue a second RFE or if they will simply reject the application if not satisfied with the submitted evidence?
