Thanks! It was Petitioner's proof of citizenship and MC. The proof of citizenship is on me since I actually missed to provide that. However, I don't understand the RFE regarding our MC when we already sent them the original one. 😂

Next time when your submitting, make sure to only send photocopies of the original. One of the stipulations from USCIS is that you should send photocopies and not originals. 

 

So just send the proof of citizenship and a photocopy of your MC for each application. So you should have at least 4 different copies of your MC if you concurrently filed.

It isn't a matter or the MC being an original or a copy. in the RFE letter, it seems like they lost our MC, it is as if we never send any MC. (See below). Plus we included the original ones because the MCs here in our county are in long form and won't fit in one-time scanning/photocopying.

They may have misplaced it,  as they do have a tendency to misplace people's well put together documentation. So just resend it along with the proof of citizenship and you should be good.

Do you mean "Marriage Certificate" when you say MC or do you mean "Birth Certificate" - BC?

Yes. I came here in the US by the K1 visa so it is required for us to marry here.

Ok. So you mean the MC from your State? Because earlier you said the MC from your country so I was just a little confused.

What you could potentially do is snap a photo of it from your phone and then print it out on legal paper

Timeline

We got an RFE for the I-864.

They want me to resubmit it and want latest year tax return along with W2s and transcripts. 

Since I filed an extension on taxes the transcripts were not ready so I included previous 3 years of available transcripts and the long form 1099 for 2020, but missed the W2s.

They also gave me a list of things I know we did correctly.

Refile the form with the latest form and sign it.

Include the SS number.

Calculate accurate household size.

You need to include 2020 2019 2018 W2. 1099 is fine. Also include last 6months paystub to show you are currently working. The RFE is general so they will list everything even correct one related to that form. Just address the ones you know you are missing

Timeline

I had my biometrics appointment yesterday at the Brooklyn ASC. Everything took about an hour, I was scheduled for 11 AM but there were a lot of people with me, so it’s not an exact time, more of an hour time slot. 

First, there was a line outside where a guy checked our appointment time and the second page that we were supposed to fill out. Then a 15 minute wait for the check in, where you get a number and a piece of paper for the person taking your biometrics so they know what you need. Again, some waiting (you can’t have your phone in your hand so not sure how long it took, but the waiting definitely took up the most time) and then they call you to one of the booths to get your photo, fingerprints, and signature. That part is super fast, feels a bit like being moved down a factory line :) 

 

No changes on the website yet, but I’m excited that this part is done!

I also think the RFE letter has generic language. And maybe some tips on the usual mistakes like to make sure you have a current form and sign and include the SS number.

 

In the original filing we included tax transcripts for 2017, 2018, and 2019 which is all I had available at the time. The 2020 transcript should be available now since I filed in September. 

Then I gave them the 1099 I filed for 2020. No W2. Missed that one.

Also did not include pay stubs.

 

I did include an employment letter. 

 

I have an issue with the 6 month worth of pay stubs and need advice from folks. Although I have been employed over ten years at my company, I was on unpaid leave during the months of May and June 2021. So no income in those pay stubs. I can include 3 months of stubs instead of 6.
