This seems to be a common RFE, where the reviewers want to see W2 & 1099s for each sponsor, and if there are none for whatever reason then a note / statement explaining why. We had to submit a signed statement from my wife (petitioner) who's 2021 tax return / income was all UK based income so no W2/1099. I empathise with you, it's very frustrating.

Do you had to resubmits W2 even though you submit IRS tax return transcript and 1040s?

Hi Ashish, it would help you try and search for your answer or read through some of the threads, as this has been discussed before.

Generally speaking, you shouldn't need to submit W2/1099 if you submit the tax return transcript, but in some cases you do (for example when sponsor filed taxes jointly but only one person from the couple is sponsoring), but we have seen many cases on here where even though the W2/1099 should not be needed, the NVC still send a RFE asking for all W2/1099 to be submitted. It seems they are working to a checklist and if there is no W2/1099 or an explanation as to why there is none they will ask for it.

Whether this means you should re-submit and go back to the end of the queue is your call, on one hand you may be fine on the other hand you may have to re-submit.

Thanks for your response.

I just spoke to someone at NVC and lady told me that the requirement is , if you file joint sponsor with someone - then you will need to submit W2. If you file just by your self and file I864EZ, then you do not need to submit W2, only tax return transcript and 1040s are enough. I think i am in a good shape.. Hopefully they review my documents soon and i have good news soon. :)

  • Your Internal Revenue Service (IRS) transcript or a copy of your federal individual income tax return for the most recent tax year. If you provide a copy, you must include a copy of every Form W-2 and Form 1099 that relates to your return. If you believe additional returns may help you to establish your ability to maintain sufficient income, you may submit transcripts or photocopies of your federal individual income tax returns for the three most recent years.

Also, it is now proved that it is necessary to scan even the blank side of a civil doc, despite NVC's claims to the contrary, to avoid adding another 3 months to your case. Don't know whether to laugh or cry at the ridiculousness of it all 😂
