AOS on K1 visa

Hi guys,

I came to US on K1 visa on 25 june and just got married 2 days before, i want to know if i have to apply for AOS before 90 days over or it was just to get married in 90 days. My i90 expires on 22 September.

Once your I-94 expires, if you haven't filed for AOS, you'll be out of status, so the sooner, the better.

To fulfill the terms of the k1 visa you must get married within the 90 days. You can apply for AOS after the 90 days, but you'll be out of status until that is done so there is a risk of removal. If you leave it too long you might get other problems like the medical timing out (requiring a new medical exam). Is there a reason you can't file within the 90 days?

The sooner, the better. Here's a thread where they delayed their AOS and had to face the consequences.

I am using guide available here and doing everything on my own , the only problem i am facing is Affidavit of support for which i will open a new thread to get help from others..

the simple answer imho is to do it asap and certainly before the 90-day K-1 visa expires.

 

The AoS forms are really very simple and there are great guides here to help and you can ask questions and folks will help.

 

I know the forms and the entire process can seem like a large challenge, but just sit down and crank out the forms in one sitting...its not even a long day.
