Removal 2 Yr Conditions Interview

Hello VJers:

My wife has been here since Dec. 2017 (I'm a USC). She received her 2 year residency. We filed petition to remove conditions for her 10 year GC and she went for her Biometrics in July and now has an interview scheduled at the local UCSIS office. We submitted plenty of documentation. Her three kids have even since received their 10 year GCs and are living here in the home with us.

 

My question is should it be a concern to that they requested an interview (since sometimes they waive them)? We are happily married and very settled together. Is the interview just a standard part of the process? We will be well prepared. We are trying to work and maintain our family and do not need more worries or stress.

Interviews are waived in case the immigrant went through adjustment of status, and even then, some are selected for interview randomly or due to certain circumstances.

She did enter with a CR1 visa. So this is normal and should not cause concern? Our marriage is completely bona fide. I could not live without my spouse. We are very much in love with one another.  Where can I find information about ROC interview for CR1 being the norm? Sorry, this has just upset us very much.

Correct.  The law does not allow her interview to be waived if she entered via a CR-1 since she has not been interviewed by USCIS, unfortunately.  No need to worry.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

None of you have been interviewed by the USCIS, therefore the requirement. You should not be concerned whatsoever.

We were interviewed in Nov. 2018 her home country before receiving her CR1 Visa but nothing since that time. Correction: She arrived in Dec. 2018.

She was interviewed by DOS, not USCIS.  Similar situation with my wife....except we have been waiting since March 2019.   My wife arrived in June 2017.

You and "Allaboutwaiting" have just put our nerves at ease. We all know it is stressful to continuously deal with UCSIS. Hopefully, this will be the last time for a while.

We have been waiting since June 2019. My husband and bonus daughter arrived in  April 2017. We are going for the 2nd infopass stamp this week. It's great that you are going for an interview and not still waiting.

So we assume it is a good thing that the interview is scheduled (since we have not been interviewed with USCIS)? We have no reason to think the documents are no complete for the I 751 filing. So how do we best prepare? What should we expect in terms of the interview itself (questions,  etc)? 

 

I'm looking around VJ for other experiences but I can't find anything. Thanks for helping.

Thanks for posting.  I don't feel quite so alone now.  We just got my wife's first Infopass stamp last week.

If your documents were incomplete, you would have received an RFE, so you are right in assuming that everything is complete. 

 

During the interview, they will just go over the form with you, to make sure everything is complete. You will be asked some simple questions that you will likely know the answers to because your marriage is genuine: when did you get married, how was the wedding, where do you live, how long have you lived there, what is your spouse's job, etc. 

 

To prepare, just go over the form and evidence to refresh your memory. If you have any new evidence that you would like to show them, you can bring that. I would not compile lots of new evidence if your initial packet was solid, but you can bring some strong pieces of evidence if anything major has happened since you filed the petition (for example, if you just bought a house together, or signed a new lease, that is something I would bring).

OP: as others have posted, it’s a standard procedure for CR1 visas. Nothing to worry about. For other types of visas that did adjustment of status the interview is usually waived if they has an AOS interview. I adjusted from an F1 visa and my AOS interview was one of the few that was waived, so I’m expecting an interview for ROC when my time comes. Nothing to worry about.

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

We went through the ROC interview about six weeks ago, pure routine and pretty casual conversation with the officer. If your case is solid, with lots of financial evidence there’s nothing to worry about…
