Staying in the USA on B1 while CR-1 in process?

Hi all, 

 

Not my case but asking for a family member. 

They have been together a year. 
She has been on a 10yr B-1 tourist visa in America for almost 6 months, which is the time allocated to her, her 6 months will expire in October and they plan to marry end of September and file for the marriage CR-1 marriage visa. 
 

She does not want to return to Thailand at the moment due to Covid lockdowns. 


The question is, can she stay in the USA while her application is pending.

20 March 2017: We got engaged!!                                             13 June 2018 - Sent AOS/EAD/AP

06 June 2017 - Sent I-129F                                                         15 June 2018 - USCIS signature received.

12 June 2017 - Case was received.                                           20 June 2018 - NOA1 for AOS/EAD/AP

14 June 2017 - NOA1                                                                   22 June 2018 - Cash checked

14 December 2017- NOA2                                                          23 June 2018 - Hardcopy i797 for AOS/EAD/AP

26 January 2018 - NVC Scan Date                                            17 July 2018 - Biometrics appt

29 January 2018 - NVC Number                                                24 July 2018 - Case ready to be scheduled for interview

07 February 2018  -Medical                                                        27 Sept 2018 - Call to request EAD expedite based on pending job offer/financial hardship

20 February 2018 -Interview: APPROVED!                               6 Oct 2018 - Letter in mail stating "Your case is currently under review"

21 February 2018- Visa Issued                                                  16 Nov 2018 - EAD Approved                                                                             

23 February 2018-Visa in hand                                                  24 Nov 2018 - EAD/AP received in mail

20 March 2018 -POE: Los Angeles                                            26 Nov 2018 - SSN mail received 

20 May 2018-Marriage                                                                06 Nov 2018 - Interview Scheduled

However, since she is CURRENTLY in the US, she can apply for adjustment of status immediately after marriage.  Upon filing a proper I-485, she will be granted authorized stay in the US until the I-485 and green card are either approved or denied.  But, she will not be able to leave the US or work in the US for 6-8 months after filing.

 

 

So if the marriage happens October 14th and her time expires oct 20th, will USCIS need to have received her application before October 20th?

USCIS needs to receive the I-485 package as soon as possible after marriage.  Once they have received the I-485, she will be granted "authorized stay".  Technically, she will be out of status between the day the I-94 expires and the day USCIS receives the package.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

The above answer is missing the first two words, LOL.  They are No, but....

 

She can stay but not work.  If she leaves the USA for any reason before receiving Advance Parole, she will not get back in.

Facts are cheap...knowing how to use them is precious...

As @pushbrk stated, if they take the AOS route and they leave the US without AP, the AOS will be abandoned along with the payment, and a new I130 will need to be filed so she can eventually get a CR1/IR1 visa.

No need for a new I-130, but it will cause delays getting the existing one to change tracks to chase a visa.
