Not marrying on k1 visa

Timeline

Can the k1 visa holder marry someone other then the person that petitioned them? I see on other groups on Facebook were people are inquiring about the process to adjust the status of a work, visitor, or student visa to a immigrate visa mostly through marriage. I always thought that this was against the rules. So it makes me wonder the same about the k1. I research on Google and of course the answer is no, but im wondering if people are actually getting around this rule.

not only are they suppose to marry the person who petitioned them/  they have 90 days to do this

someone trying this can not AOS and work in US 

 

The K1 beneficiary may only adjust to lawful permanent resident status under section 245 on the basis of his or her marriage to the U.S. citizen petitioner. INA 245(d); 8 CFR 245(c)(6). 

 

 

Thus, the K1 beneficiary's presence in the United States becomes unlawful if he or she has not married the petitioner within 90 days. The statute and regulations are clear that a K1 beneficiary cannot adjust status on any basis other than marriage to the petitioner.

 

Forget Facebook when it comes to immigration

The k1 visa holder must marry the person who petitioned them within 90days of arriving in the US. Otherwise, this will open the immigration system to so much fraud.

They can be petitioned but would need to go back home and go through consular processing

This is different. Some people come on an F1 visa to study, and while they’re here, they meet someone and then eventually decide to marry. Same for work and tourist visas.

FROM F1 TO AOS

October 17, 2019 AOS receipt date 

December 09, 2019: Biometric appointment

January 15, 2020 RFE received

January 30, 2020  RFE response sent

Feb 7: EAD approved and interview scheduled

March 18, 2020 Interview cancelled

April 14th 2020: RFE received

April 29, 2020 Approved without interview

May 1, 2020 Card in hand

 

REMOVAL OF CONDITIONS

February 1, 2022 package sent

March 28, 2022 Fingerprints reused

July 18, 2023 approval

July 20, 2023 Card in hand

 

N400 

January 30,2023: Online filing

February 4th, 2023: Biometric appointment

June 15th, 2023: Case actively being reviewed

July 11th, 2023: Interview scheduled.

August 30th, 2023: Interview!

August 31st, 2023: Oath ceremony scheduled.

Sept 19th, 2023: Officially a US citizen!

The K-1 is a special animal.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You can marry whoever but you can't adjust via marriage to anyone aside the person who got you the K-1. So if you do you pretty much have to proceed as if you entered without inspection - if you overstayed for less than 180 days, leave the country ASAP to not get a re-entry bar and if you overstayed for more than 180 days you'll have to do an I-601A waiver, then you'll have to do consular processing.

 

You can also likely do cancellation of removal, but that's a completely different can of worms.
