It was refused in 2016. We have been married since 2017 yeah

What was the reason that they gave?
Do you have any red flags? Convictions? Anything that you think will maybe create any problem?

I say that because I expended $3k with a lawyer that just makes my case slower and with a lot of mistakes.

Hiring a lawyer depends on the complexity of your case, if you feel you need a lawyer then do hire a lawyer and if your case is straight forward then you don't need any lawyer unless you don't care about spending money unnecessarily.

I have no legal problems at all. The officer said the will need to review the file further. Then after few weeks we got the senator involved to ask what is the status since they were not responding to our emails. The consulate replied that the officer was not satisfied that the relationship between us is real and petition was sent to USCIS for reconsideration

K1 and IR1CR1 are two different types of visas. I can't tell you about K1 but I sure can tell you about IR/CR1. Although we did had a lawyer but all he did was take the fee and fill some forms the rest I did my self all the evidence and stuff. I sent along with my petition the pictures of our ceremonies, chat logs call details, money gram receipts and her visit records etc  when ever she visited me and I still got an rfe I don't remember what they asked but I think it was some thing simple. Long story short what ever type of evidence you can think off which can prove the legitimacy of your relationship just send it to them and hopefully it will be approved if they need any thing else they will ask you.

Hopefully whichever lawyer you go with will also tell you what you will hear from experienced VisaJourney members, which is that to overcome this you will need to spend much more time together in person.

If finances are tight, I'd say that the $3k+ you could spend in lawyer's fees would be much better spent on airfares to see each other so that you can overcome the presumption of green card fraud.

Having married and lived together for several years now, I would think you have greatly strengthened your case.
