Asking for a J1 waiver (government agency) (merged topics)

Hi, 

 

I am in the process of applying for a EB-2 but I first need to waive my two-year rule. Therefore, I am asking for a No Objection Letter from the French Embassy. They request two recommendation letters without mentioning any details (link to required docs).  Can anyone recommend what these letter should include/emphasize on ? That would be very helpful. Thank you

This is for the embassy, so you might get better luck trying to find French citizens who applied for the waiver.

 

I got it for another country and I had a job offer at the time and there were no comparable jobs in my country. So I wrote that and it was very brief. 

 

It depends on your personal situation but I doubt your embassy would not give you the letter.

Hi,

 

I got my 212e during an internship at NASA in 2013. In my DS-2019 it is only written personal fund in the financial support section. I have read that it is very hard to waive a 212e with Government funding, but while my internship was done at a Government agency, I did not receive any funding from either them or my home government. Will that impact my waiver application ?

(1) What matters most is where the FUNDS are coming from, not the LOCATION of the internship. If they spent no money, they'll probably accept it.

 

The most difficult waivers are Fulbright. Others government agencies give waivers all the time. If this was like a couple of weeks internship, most likely you will get it. Just make sure to write a nice statement of why you want the waiver, because the agency will receive that. You can also find out who within NASA (or the specific department listed in the J1) decides the waivers and email them making inquiries.

 

(2) You don't have to stay 2 years all at the same time. Any trip you've done since 2013 counts towards the two years.

I have spent a lot of time at home but I also got 2 J1 visas since then, both without the 2-year rule checked on them. Would that still count towards the 2-year rule or do the 2-year "clock" restarts at each J1?

Any time since the day your J1 ended. If your J1 ended in 2013 then any time you've spent in your country between 2013/4-today counts towards the 2 years. Even if you went for a holiday, it counts.
