She can enter on a tourist visa and would only be allowed to stay for the amount of time authorized at the POE.  That can be a few days to 180 days.  It is extremely hard to get an extension of that time.  But you can marry and then return to the Philippines with her (9a visa currently needed).   I am not sure what the point of a CR1 is if you plan to live in the Philippines.

August 2, 2018 Case Complete At Consulate

September 25, 2018 Interview in CDJ and Approved!

October 7, 2018 In the USA

October 27, 2018 Green Card received 

October 29, 2018 Applied for Social Security Card - November 5, 2018 Social Security Card received

November 6th, 2018 State ID Card Received, Applied for Global Entry - Feb 8,2019 Approved.

July 14, 2020 Removal of Conditions submitted by mail  July 12, 2021 Biometrics Completed

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

That was my point.....a year on a tourist visa is extremely doubtful.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Good Point on the CR1. As you may well know it's crazy times in the Philippines.  With the 10 day quarantine on entry, and Covid situation staying the same or getting worse in the last 17 months, and now we have the wild card of a Presidential Election in March 2022, I am concerned they may have riots in the streets after the Presidential Election and the country could be in turmoil for a few months or years.  For sure I wouldn't go back and was thinking my girl could just stay here in the USA and we apply for her greencard if Phiippines is in turmoil for a long time.  

 

The point of CR1 was stepping stone short term solution to stay in USA until Philippines gets back to normal.

I would just enter on the Balikbayan Visa if I get married and return with her, no need for a  9a

 

I would do a 13A Permanent Residence Visa after a few months

u can't plan to do this

 

the person is asked at POE "who they visit"   and many get turned back for visiting a BF or GF as officer may assume intent to AOS

and even if she doesn't know,  u do   /u can't plan to do this 

I can do any kinds of plans and alternative plans  I would like to do.  I am allow to think and weigh my options.  If you would of read my original post it said  "  If a person comes on tourist visa and during the stay they decide to get married " you would of had a better understanding of the question I had posed.

It's even allowed to have the intent to get married during a genuine Tourist visit: https://uk.usembassy.gov/visas/immigrant-visa-faqs/

If you will return to your permanent residence you may apply for a tourist B-2 visa, or if eligible, travel visa free under the Visa Waiver Program.  At the time you apply for the visa and/or travel to the United States you will be required to show that you have a residence outside the United States that you do not intend to abandon. There is no set form that this evidence takes as it varies with each person’s circumstances.

 

Can even file I-130 petition for consular processing during the US visit (but this is moot since you mentioned your goal is to live in the Philippines).

 

If she visits the US then she shouldn't stay beyond the I-94 date.
