Spouse with approved I-130 traveling to U.S. on B1/B2 Visa

Hello

 

My husband who lives in Grand Cayman has an approved I-130 and we are now documentary qualified from NVC and waiting on the interview.  With border closures in Grand Cayman, it's been very difficult this past year to see on another and he'd love to visit on his valid B1-B2 Visa while we wait for the interview in Jamaica

 

I've seen very mixed views and thoughts scattered throughout the internet.

 

If he does not have immigrant intent (lease in cayman, a job and work permit in cayman, bills, a return ticket back), will he have an issue being approved for entry?  My biggest concern is that he gets denied and detained (no regular flights back to Cayman) and all of the waiting and work over the last 1.5 years is out the window.

 

Any advice is welcome!  Thank you!

Visiting the US during the spousal visa process is allowed assuming he can convince CBP officials at the US border that he will return to his country at the end of the visit.  He should be prepared to show evidence that he will return.  Good luck.

BTW, an approved I-130 is evidence of immigrant intent.  He must convince CBP that he does not have intent to enter the US and adjust status.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal
