can a CR1 turn into a IR1?

hello guys !

so I had my interview last december it was already 2 years marriage anniversary , when they granted my passport it didn't say IR1 it said cr1 SO i ARRIVED IN THE STATES february 4th and they send my green card 3 months later, and guess what it said "IR1" . the problem is i was listening to an immigration attorney live on youtube and said that sometimes they make a mistake. to be honest I dunno if I'm on cr1 or IR1 and I dunno if i should send the form in two years o Im fine for the 10 years

Usually the mistake is not processing the petition as IR1 after the 2 year mark.

 

As long as you enter the US after your 2nd anniversary (activate the visa), it is supposed to have been converted to IR1.

 

Anytime prior to that, it is CR1

 

You had your interview after your 2nd anniversary so it was already IR1 for you.

 

Even if you filed it before your 2nd anniversary.

This is standard procedure.  What is printed on the visa is irrelevant.....The date of your interview is irrelevant......What CBP writes in your passport is irrelevant.  2 year green card vs 10 year green  card is determined BY USCIS when the card is processed.  If the length of marriage is 2 years or more when the visa holder enters the US, then a 10 year Green card should be issued.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Your card is correct.  There is no need to remove conditions.

Yeah that's normal. Whether DOS issues you a CR1 or IR1 visa depends on how long you've been married as of the time of the interview. It was more than 2 years so they gave you an IR1.

 

Similarly whether you get a CR1 or IR1 green card depends on how long you've been married as of the day you enter the US. So you can get a CR1 visa, wait until the second anniversary, enter, and get an IR1 green card.

Contradictions without citations only make you look dumb.

So here's another question for anyone on the whole CR1 / IR1 entry time line etc...

 

I'm hoping for a successful CR1 process to conclude in the next few weeks/months.  Let's hope I'll be armed with my shinny new CR1 visa in my passport if all goes well....  if I visit my wife for a couple of weeks before returning to the UK for selling-up and sorting my affairs (which could potentially take another 6 months of coming and goings...    am I required to activate my  CR1 upon first arrival in the US next month or so?

 

Could I not continue to enter and leave on my visa waiver in the knowledge that being able to arrive AFTER my 2 year wedding anniverary and "clocking in then officially," I would be advanced to the full 10 year Green Card?

 

Wouldn't that seem so much easier???

You can try and some (Canadians mostly) were able to not activate their immigrant visa until later but unknown how that would go for you. CBP may insist you process as immigrant on first entry. Be prepared for either way.
