I was married before but he got denied visa after interview. I’m now divorced and in a new relationship wanting to file K-1 and don’t want to make the same mistakes. I’ve attached here my email exchange with the embassy so I can get understand what I can do better with providing this time around since they were very vague in explaining what evidence they wanted to see from us.

Your first case was refused because they did not think you had a valid relationship which seems to have turned out to be the case.

As far as your second case is concerned make sure you do have plenty of hard evidence to support the validity of your relationship.

Yes, and this includes plenty of quality "face time" together.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

So we need to take FaceTime photos or screenshot our FaceTime call log? Or you just mean real face to face time (in person)?

Face to face, trips you have made places you have been.

Ohh I see, do you think 2 visits is sufficient? I wish we could meet every month but right now flight tickets aren’t the cheapest not to mention the financial obligations we have already

We had a 1 week visit last week after about 4 months of dating online (video calls/phone chatting everyday, phone calls, seeing and talking to each other’s families on video and phone as well). He’s sent me and my son gifts through DHL and I have bought him gifts as well.

Gifts are not prove of relationship. Focus on face to face meetings.

You are dealing with a high fraud consulate, you have a prior issue, you met once and filed.

Reasonable to expect major problems.

I see what you’re saying….sigh😩 Thank you for your honest and prompt reply🙏🏾

met in person for 1 week after talking online just 4 months?

meet at least 1 more time before u even think to file

you have moved too fast into a relationship in a high fraud country

I am not trying to discourage u as we ,  here in VJ,  are quite serious in our quest to marry and have our mate here on approved visa

but go a bit slower and look at what immigration says as i , too , had to deal with a high fraud country and it took us 6 years to get the visa

this is not fast (even the K1 is taking a year or more),   it is not easy,  it is not cheap

Hope u do find this person can make u happy

Open the following site to see what immigration deems "Red Flag"  issues and why they could deny a K1 visa

this site is an eye opener
