Gurdip,

I am assuming that your fiance called DOS in the USA. Did you already have your K1 interview? And if so were you given a 221(g) and what were the grounds? Did they ask for more paperwork?

AP can be issued at any time during your processing from the service center, NVC, or embassy level. Once your case goes into AP they will do a more indepth check of your name, background, or the relationship. No one can tell you how long this process will take and no congressman, senator, or lawyer can get this process expedited since AP/AR are considered a matter of National Security. I know lately the embassy your coming from is asking for more information and issuing several 221(g) for this information and once it is returned they will then continue with your processing.

If at the very end of your processing and the embassy has doubts of your relationship, found information that they feel would not allow you to get a visa then will they return your petition to the USA for further review or issue a NOIR/NOID (Notice of intent to revoke or deny)and your fiance will get a letter stating why they are not ready to ajudicate the visa.

Mary

Basic: Interview and submit fingerprints for security checks

Prints checked and name checks once completed information cabled back to embassy

If CO is not in any doubts and all checks have completed cleared the visa is issued (ajudicated)

If CO has doubts on the relationship he will then order AR/AP and then it is in his/her hands on how they proceed.

Everything I respond to is from personal knowledge, research or experience and I am in no means a lawyer or do I claim to be one. Everyone should read, research and be responsible for your own journey.
