Do Joint Sponsor need I-864A?

I recently came across this. I just want to clarify myself.

 

NVC DQ me already, I didn't provide any I-864A for my sister's husband. Someone says the embassy will require it?

 

1. Her income is more than enough to joint sponsor my petition.

2. She has joint tax files with her husband.

3. Her husband is not really good with our family.

 

They took her W-2 for 2019 and 2020.

Based on the I-864 instructions, it is not required.  But, the consul officer MAY ask for an I-864A at the visa interview.  If the CO asks for it, then it becomes required.

Exactly.  Note that the I-864 is a contract, and its final approval is a judgment call by a Consular Officer.  They tend to want to know both spouses are good with the contract.  Sounds like one of them, in this case, may well not be.  You've read the contract part, right?
