Top terms of nikah or marriage in Islam are: first : presence of both , the male and female . Second no one should be forced to be married.both should be satisfied and agree to marry each other. Third the presence of both parents or the guardians in the time of wedding. Plus Witnesses then publicity.there are too many terms.but those are top . if you have those in your party.consider yourself married.

May I ask why they place you in AP?

I would not get married nor have a party. Don't risk your Visa. I was in AP for 18 months for God knows why, so don't risk anything.

I actually don't know. I mean, they said that her visa was approved at her interview, and they even gave her a letter saying it was approved as well. Then a week later we received the email saying they would hold her visas for a minimum of 90 days and possibly longer.

What if I cancelled the Islamic wedding and just had the party? Since it's going to be difficult to cancel the venue  and some family has already purchased plane tickets, maybe it would be fine with the embassy if we simply had a party and the party would just be to celebrate the eventual marriage in the US. The Islamic ceremony is a different event and can just be cancelled altogether since there were no deposits made for that event. Do you think that would be fine?

Why ask a question then when people give you truthful answers, you still try to find a way around it? You and I both know that having an engagement party in Islam equals marriage.

As someone already mention, there is a mixture of traditions going on that makes this difficult so try and keep it simple.

Western tradition, after engagement it is easy to break it off, most other traditions, engagement literary means you are going to get married.

So to get the k1 visa, you have take a bit of the western tradition which the COs understand, having an engagement party in the traditional sense is not something taken easily. I think that is why COs see it that way.

Don't jump the gun, waiting 3 months is a lot easier than waiting 2 year.

Don't know how you will handle family that have already planned travel

It seems to me that since the religious ceremony isn't recognized officially in either the US or my fiancee's country,

BTW don't know why u think this is not recognized by USA and immigration

i married under Muslim tradition in Morocco

They have her passport. She is going through AP. Anything can change in that time.

AP usually will means a backlog, further investigation and or whatever they have to do.

If investigation and they find out that you guys are now married, the visa will be denied

K1 visa says that you guys plan to get married in the US within 90 days. Stick to the rules and you will be fine

Also, there's no statute of limitations for immigration fraud.  Even after the visa is approved, an immigration officer can investigate if there's any suspicion that the intending immigrant was not actually eligible for a K1 visa.

Here's a report from a VJ member who was questioned at the AOS interview about possibly being married before entering the US with a K1 visa --
