Fiancé under medicaid

Hey everyone,

 

My American fiancé has 0 income and is a student. She turns 26 soon and is removed from her parents’ health plan. Her mom would be our joint sponsor (mom has her own private insurance).

 

Would my fiancé having a medicaid plan hinder our chances of the CR-1 sponsorship?

 

Or should we apply for a private insurance for her? If so, where would be the best place to look for it? Getcovered NJ/NJ private insurance marketplace says she is not eligible for private insurance and only eligible for medicaid due to her 0 income. We are unsure about how to get around this.

You don't get around it.  The public charge decision (reason you need qualified sponsor) is a judgment call that considers totality of circumstances.  Being on Medicaid alone is not a disqualifier but the rest of your circumstances COULD BE, like WHY she has no income, and circumstances of your relationship etc.

Facts are cheap...knowing how to use them is precious...

Many colleges offer medical insurance plans to students, which may be funded directly by the school or through an insurance company. College students can stay on their parents' health insurance plans until they're 26 years old – even after they graduate.

 

Fiancee or spouse?

CR1 is for spouse and K1 for fiancee

she has to show she can afford health care insurance for u
