Yes, you filed too early.

If you file even 1 day before the 90 day window opens USCIS will reject a joint i751 application (or a n400 application for that matter as well).

From what I can tell, I believe that our packet is completed.  We followed what USCIS and Visa journey guides when completing the packet.

 

I've tried to call the USCIS, but this new voice automated system and EMMA is just HORRIBLE!  I can't get ahold of a human.  I want to know when we resubmit, do we need to send new copies of everything (USCIS has printed the tracking stuff at the bottom of every page)?  Can we reuse these money orders?  Someone wrote on them, but never cashed them.  Do we need to make a new i-751 form since the date originally signed was in mid August?

 

I feel like I should just make a new cover letter and resend the packet, kind of annoyed.

There are people whose package was returned for sending it one day early. It seems petty, but there it is. You should be able to resubmit your package as it is, as long as everything is signed and filled out correctly.  Letters from USCIS are often form letters and not everything always applies, so this doesn't necessarily mean that you haven't included everything or signed where you should. I can't answer about whether your money order is okay with whatever it is they wrote on it.

Oops. Thank you for the correction! I had quickly googled about filing the form online and the [non VisaJourney] website that I checked with mistakenly said it was available for online submission. I should have fact-checked better before posting here. Apologies! :)

We did not file too early (waited a week after window opened).

 

You can refile if your i751 application is complete. Best evidance joint bank account statments for full 2 years, joint IRS tax transcripts for up to 3 years, W2 and 1099s for whole marrage from both, state issued IDs (diver's licenes) with same home address, joint lease or mortage for 3 years, kids birth recoreds... If you have most of that stuff then yes you can refile what you have.

My Cuban spouse and I went through the fiance route and so we both had to fly to Guyana for the embassy interview and then had another one for AOS here in the US at a USCIS office. So, I'm hopeful that with a lot of evidence of the bona fides, they will just waive this last one before he goes for the naturalization one in a couple of years.  

There is a good chance that your interview will be waived since you had an interview for AOS. It depends on the strength of your evidence. Specifically your lack of evidence. You can tell a lot by which office your case is routed to. If it goes to MSC (NBC) it is almost sure that you will get an interview for ROC. Of course nothing is for certain as we all have learned with USCIS)

They do reject packages for being even a day early so yes, that could very well be the reason.

Hi all! Good luck to everyone, I hope its a smooth process to all of us.

 

One question, how long is taking for them to send the paper that you are currently waiting your process and you can travel again? And the overall waiting is still 14/18 months?

Alright I sent mine yesterday. Delayed cause of USPS sending back my intercepted mail took 2 weeks! But all good, I prevented it from arriving in USCIS and rejecting it. Whew!

Hi everyone!

 

USCIS received application (removal of conditions) on: 9/13/21

Received receipt of application: 9/20/21 with the 24 month extension 

 

Hopefully no biometrics or interview needed. I saw that the Texas Service Center is the fastest so hopefully I get my green card fast! Good luck to everyone!

Three  Questions : 

1- I saw one of the lawyers I-751 cover letter , end it with this

 

Pursuant to 8 CFR §216.4(b)(1) and in consideration of the enclosed evidence we respectfully request that the interview requirement be waived.

I appreciate your prompt attention to this matter and respectfully request your favorable adjudication of this petition.

( I googled that 8 CFR §216.4(b)(1) ,  wow!  a lot of great info ! )

 

"Question, Can I included that in the cover letter even I am not a lawyer ?"

 

2- I received the affidavit from friends & neighbors ( they are obviously very busy people and took the time to write and notarize and I thank them so much for that )

However I see  my name miss-spelled in one of them ( one letter wrong) ... The 2nd affidavit  , printed out in away .. the last word or letter in each line missing , due to printer alignment as it seem   .. I know they are busy and I don't want to take their time again .. 

Is it possible I take it to the notary myself and show the typo myself to be corrected ? ( Obviously the signature of the writer already have been notarized, all I need to fix the typo without effecting the legimtacy of the affidavit and without disturbing my neighbors again ! 

 

3- I see in the thread , if you do ,Money Order ? or Cashier Check ? it will be cleared same day Vs. personal check they have to wait on the check to be cleared ?! 

Can you elaborated on the  money or cashier check , what exactly to be written on it please ?

Hi everyone!

 

We are about to file for the petition to remove condition. My husband's GC expires in March and we are going to mail out the application tomorrow. When we receive the NOA does that give us any type of extension?  Anyone knows what the process time is from start to end with Covid restrictions being applied? We are also expecting our first baby and included OB letter to state such and medical records with Ultrasounds as well.
