Apparently pigs CAN fly.  The USCIS was amazingly fast.  Two days after online submission of my wife's N400 we received a status update for our I751... the first in a year TO THE DAY... indicating it has been transferred to another office (NBC).  So Vermont is now out of the picture and it appears we are now in the queue waiting for our local office to make the next move.

 

After 1 year of nothing, we have status updates, notices being sent.  It's refreshing.

Are you applying under 3 year rule?

Did you file jointly?

Are you still together?

Did you live together in marital union for at least 3 years - 90 days and you've been a LPR at least 3 years - 90 days?

Do you pass physical presence test?

Yes I am applying under 3 year rule and still together and been a LPR for a lil over 3 years. I just read on a website that i had to be living in the states 3 months prior to applying for N400

You need to be a resident of the state you're applying in for 3 months. It doesn't mean you went away for vacation for few weeks that you need to be home for 3 months before applying.

 

If you were away (outside of US) for 6+ months, that's another story. Your continuous residence resets, and you start counting from the time you arrived back from the long trip. Meaning you wait 3 or 5 years from the date of that entry.

You should be physically present at the time of the application. Here's the reference.

Good assumption to have a combo interview but not likely to get an i751 interview invitation. Be prepared to do both ROC and naturalization combo interviews at your appointment even if you don’t get a separate ROC invitation.

In our case only n400 invitation was sent to us, we were both called into the interview so bring your spouse to the appointment.

Fingerprints reused October 2020, and February 2021 and June 2021 (Yes 3 fingerprint notices)

Case move to National Benefits Center December 2020 for quicker processing from California Service Center

Oct 2021 out of processing time inquiry made, response May 5th 2022 that our i751 case will be addressed at our n400 interview

Combo interview May 16th 2022, in Sacramento

Approved June 08, 2022

 

Filed for Naturalization May 2021

Fingerprints reused May 2021

No it's not ok not to mention it. Say yes to the question 23 "Have you ever been arrested, cited..."

 

And provide details and evidence of paying the fine.

One of the questions on the N-400 asks if you've ever been cited by law enforcement. There's a space to provide information about your case. 

 

I would definitely keep all evidence showing that you have paid your fine and take it with you to the interview!

We submitted my wife's N400 online.  As part of that submission we included a letter referring to our pending I751 (we included the case number) and expressed our hope for a combo interview.

 

We then subsequently received a transfer notice in the mail for our I751 to the National Benefits Center.  In the transfer notice we saw the words, 'In order to speed up processing...'

 

Last night the status of the I751 changed to Case Was Updated To Show Fingerprints Were Taken.  Seems to suggest background checks could be happening soon.

 

Have others in our situation experienced the same thing?  I am wondering if the National Benefits Center is working to adjudicate the I751 when what we were hoping for was a combo interview at our local field office in Boston.

 

Thoughts?
