@Southern_Belle07 seems to understand your question better than I did. I thought the you asking about the date to file your application. Sorry about that! Actually, according to USCIS instructions, they want to see paperwork from the time of the beginning of the marriage. It does seem redundant, because the first few months were included in the AOS package, but we chose to not take any chances and include those first few months with our ROC package anyway. It didn't make our package that much bigger and is worth the peace of mind. USCIS wants to see, not only current paperwork, but evidence of financial comingling that's been active for the entire time.

You make a very good point too! 🙂

Thank You!

It's astounding to me that so many attorneys tell us what they think the law is rather than finding out what the law really is concerning immigration. I know what you mean about the package becoming a second full time job. My husband will be applying for citizenship next year, too, and the day will come when we'll never have to deal with this again!

What's even more important is current USCIS practice. You are more likely to get a clear answer her on VJ than asking a lawyer on some of these process issues.

Finally done...

Unfortunately a lot of attorneys just want the money and don't really take the time to read the laws! One thing I learned while dealing with immigration is that nobody, not even the most qualified attorney, cares about your immigration path as much as you do. It's horrible because one wants to think that attorneys are there to help, but in all my years here in VJ I've seen attorneys make some atrocious mistakes!

Why does the topic of whether to use an attorney or not keep popping up?! It's like beating a dead horse.....

For all of our USCIS filings we never used an attorney and more than likely would never use one for any future filings simply because we don't want to spend the money on something we can do ourselves. It's not so much because we think attorneys won't be able to do a better job or that they are unknowledgeable in regards to immigration....it's more the money aspect of it.

But that's just me. Whether a person wants to use an attorney or not is their decision. Maybe someone doesn't have the time or the skills to properly put together their filing....maybe English isn't their first language and it's difficult for them to interpret all the instructions.....or maybe they have deep pockets and money isn't an issue and hiring an attorney is just easier......who knows?

This forum is for us as a community to share experiences and offer advice.  Why is it that whenever the word "attorney" pops up, a bunch of people start coming out and making people that use attorneys feel like idiots? Not everyone is the same or thinks the same. If anything it actually discourages a lot of people from posting simply because they're afraid of getting chastised.

It's also funny how so many people keep bashing the use of attorneys when Visa Journey itself states in it's Terms of Agreement that people should always consult with an attorney. There is also even a link to ask for a Pro which puts you in touch directly with an attorney/law firm.

And I want to make clear, I never used an attorney nor would I ever use one for USCIS filing purposes.

Still no activity here (Biometrics waiver/appt notice). WAC (California Service Center) here. Any WACs receive anything yet?

No update for my wife’s file either. Her center is WAC as well. Based on what I have seen on Google Spreadsheets, we are not expecting any update on biometrics before Jan or Feb (4-5 months from filing date). Hopefully it will come sooner.
