Yes, by the way the @NineDev ban is nothing to do with citizenship and only depends on where someone has been physically present in the two weeks before trying to enter the US. But again, a spouse of USC is exempt.

So getting married would still allow me to visit him while the CR-1 is in place? Or would I still need to stay somewhere else first?

You are correct.  It would be expensive......but several fiances have done it (staying in Mexico for 2 weeks).  I remember one person who did have difficulties trying to leave Mexico.....

It’s not necessary to spend two weeks in Mexico surely when he can go to Europe? Even if France is going to be “zealous” you can meet plenty other countries in Europe.

Unfortunately this is what happens when immigration is involved. There are many more hoops if you follow this process….

Looking at the list of European countries banned, it's pretty much all the ones I could realistically go to haha

I'll look around still, Mexico is still an idea, and I suppose Russia is too, but being in a same-sex relationship does make me anxious about certain countries (not that I wear it on my sleeve, but it's still a worry in my mind).

You can visit while the CR1 in in progress.  You would be exempt from the travel ban.

I am not sure what you are not understanding about people here repeatedly saying the spouse of a USC is exempt from the ban… exempt is exempt …

you miss the point of the second part, it is for him to visit you as you suggested earlier (you were worried he could not because of the “ban” that isn’t actually a ban) not for you to be somewhere else for two weeks

Oh, I just wanted to make sure, I'm sorry if it came across that way! (I also just got what USC means, so that's my bad for that haha)

All the information in this thread has been very helpful, so I'm very grateful!

An option might be to meet in Denmark and get married there. Fully vaccinated people can travel to Denmark from the US and EU countries, and getting married there seems pretty easy for international (same-sex) couples. Denmark is set to lift all domestic COVID-19 restrictions in 10 days, so it would probably be a pretty enjoyable visit with places opening up again. Just an idea you might want to look into.

I do agree with everyone else that the CR-1 is the better option if you can make it work. On top of the advantages of the CR-1 already listed, I think you might also be getting pretty close to not being eligible for the K-1, because you have to have met in person within 2 years before filing the K-1.

Denmark definitely seems like an interesting option I've been thinking about too!

We technically have until June of next year for our eligibility to run out for K-1 (last time we saw each other was June 2019, he came over in March right before everything closed down), but we both agree CR-1 seems like the best course of action after talking to people here.

UE says this according to New York Times 3 hours ago

In addition to taking the U.S. off the safe list on Monday, the European Council of the European Union, the bloc’s governing body, released a recommendation urging member countries to issue travel restrictions for visitors from the United States who are unvaccinated against the coronavirus. The European Union is encouraging authorities across Europe to reinstate the sort of mandatory quarantine and testing requirements that seemed to be on their way out, though only for unvaccinated travelers.

Ultimately it’s up to a given country to decide if it wants to issue new requirements, however.

OP   marriage is the best overall for the process

if one of u can not travel to the other's country,  there are many countries were u could both travel to and marry

If one of u can not travel at this time and u have met in last 2 years,  K1 may have to be your choice but do it before that 2 years runs out

Your US fiance can travel through Spain, then go to France by car. Nobody asks anything while crossing the border. In June I (US citizen) flew to Barcelona, rented a car and entered France through Jonquiera-Pertus. Much easier this way in order to avoid all the hoopla of the Paris airports. All I needed for my flight to Spain from the US was to fill in the Health Certificate online. For the flight Spain-USA they required a fresh COVID test which can be done within 48 hrs either in France or in Spain.

As of August 1st Air France requires a PCR test done 72 hours before the flight / just did this for Air France for Adil to fly home from Morco and flying transferring in Paris

so,  some of this is controlled by airline regulations to get on the plane

Another consideration for the future, once you are married, for your husband to visit you in France: as the spouse of a EU citizen he will have Freedom of Movement rights which will make it easier for him to enter the Schengen zone. Many Schengen countries who have Covid restrictions in place for non-EU travelers have exemptions for people who have Freedom of Movement rights.

Do a Zoom marriage, then as spouses, your travel options open up.  The only catch is you won’t be able to submit the I130 for the spousal visa until after you actually meet in person.

Please clarify -- was your most recent in-person meeting in June 2019 or in March 2020?  If it was June 2019, you are no longer eligible to file for K1 unless you meet in person again.
