Hello All

 

This might be a long story but hopefully you have the time to read. I am originally from Africa. I have a big family in the USA including my grandparents, uncles etc. My grand father filed a petition for my family when I was a kid which got approved and my parents are now in the USA. By the time it got approved, I was already over 21 years old so I was dropped of the petition. I moved to Canada for school few years ago, applied for a visit visa to the USA twice, my parents are still not in the USA then, and both visas got denied.  in 2015 me and my fiancé, my wife now, applied for a K1 visa but again that was denied as the officer was not convinced of our relationship. We then decided she would move to Canada. So she did, and I applied for her to become a Canadian PR.  I am now a Canadian citizen and planning to go for a quick visit to see my parents there. My wife and son went a head of me via land to see her parents last week, cheaper via land. And I am planning to go there via airplane for like a week or so.  I just with all these denies, I am too nervous to go through customs. I am just going for a week or so and coming back. I have a full time job and I can collect all documents that prove ties to Canada. Should I go ahead and go for a Visit or you think they will give me a hard time and worst case give me a ban?

Thanks. No I know. I am just worried with all previous immigration visa denies, before obtaining Canadian citizenship, they will just assume I am immigrating there, which I am not. Probably I am over stressing.

The previous denials should not impact you unless there was something serious that would have resulted in a permanent bar from the US.  The story you related did not seem to indicate that.

Thanks. Yeah I do not have any bans. I am just stressing because I was denied two visit visas, one K1 visa. Now I go for a visit they get upset and bar me. But now I have a Canadian Citizenship so I think that helps

Canadian citizenship helps a ton, but one thing you need to check very closely is any requirements for entry into the US.  Since you are traveling by air, I don’t think the land crossing restrictions apply, but you may need to get a Covid19 test prior to departure.

Thank you for taking the time to reply to me :). Yeah those restrictions I am already familiar with. I have to bring a proof of vaccination and a negative covid test

I think your situation now is a lot different from your situation when you applied for the visas earlier.

 

Back then, you were a student, so likely did not have strong ties to Canada. If you can now show that you have a job, house, etc, to go back to, your chances will be a lot better. Plus, being a Canadian citizen now probably helps too.

 

I think the denied K-1 visa is irrelevant; and by now you have also shown that they were wrong when they denied you, because you ended up marrying her anyway and she immigrated to your country.

Thank you so much. Yeah I have a job and and have a lease and will take our ongoing lease and a letter from work with me. I am probably over stressing but it is better to be over prepared than getting surprised lol.

Just to update this for anyone who has a similar issue/ concern. I was able to visit successfully. I was taken to secondary and asked a bunch of questions about my previous visas etc but at the end I was admitted.
