Hello, I'm pretty sure this has already been asked. But i'm still fairly new on using this website. 

As for filing for the k1 visa, when do we have to submit the affidavit of Support? I have been told from someone on another website (reddit) that we don't have to fill this form out until way later when my foreign fiance already gets their appointment interview date? But I just want to ask and make sure.

About myself, i'm currently a college student. I get paid $1200 dollars every month for 9 months just for being school in full time. I also have a job and I get paid around &600 per month from my job. So that's $1800 each month i'm bringing in. I also just got a job promotion recently and I may be making $15 an hour (that's just what i've been told , but I know i will be getting a pay raise anyways). 

Last years income taxes, I wouldn't have meet the income requirements because covid happened and i was unemployed. But when i file for taxes next year, I know i will be able to meet the income requirements for the year of 2021. Anyways, i'm trying to see if I will be able to sponsor him by myself without needing a co-sponsor/joint-sponsor?

 

I have also been told from a person on reddit that I can also show them my month to month earnings? But I just wanted to ask from you guys

Any advice is appreciated. I'm sorry for being everywhere, but i just want a thorough explanation on this as much as possible.

That is correct. Form I-134 is submitted during the interview step.

Yup, at that time submit the most current pay stubs since current income is what will matter.

If I were you, I'd have a joint sponsor lined up.

Do you mean your student loan?  If so, I seriously doubt they would count it, and it could work against you.  Others will know better.

I agree with @Jorgedig.  Be safe and get a join sponsor, or at least have one on standby.

I agree with @Jorgedig.  Be safe and get a join sponsor, or at least have one on standby.

It's actually not a student loan. They are VA benefits. My step father is retired from the navy and he discovered this when they told him that even his step children can enroll in this and receive the 1200 each month for going to school. 

 

 

Will the VA benefits work perhaps since it's not a loan? But i will try to see if i can have a joint sponsor .

what works is what you have to report to IRS for income (if any)

but these benefits are while u are going to school and not for life so only income from work counts

you definitely need a joint sponsor to fulfill the income requirements

and fiancee needs the I 134 from  u and joint sponsor to take to interview along with IRS transcripts (if u had to do them)

 

and u are just doing the K1 petition (post says August) so this will take some time to get to the interview stage (looking at over a year)

and hopefully you'll be in better financial shape _line up a joint sponsor -follow the guides above and look up the income requirements for income for2022 when they are announced  100% of poverty for K1  and after marriage in USA 125% of poverty guidelines for your AOS , EAD and AP

those are costly at $1225 presently

 

Please do a timeline when you send the petition in and keep up with the info   Thanks

ah okay... 

Thank you for sharing with me on this. I am hoping I will be in a much better financial position next year. I graduate school in May of 2022. And because the interview is close to a year long wait, I do want to submit the paper work since it's a long wait as well as hoping I can get a good paying job right after I graduate.

Form I-134 "obligation" is rarely (if ever) enforced. At most it's theoretically only in effect for the 90 days of K-1 status.

 

The Form I-864 for Adjustment of Status is totally different. Once the Green Card is approved then that obligation only ends when the immigrant:

  1. Becomes a US Citizen;
  2. Has worked, or can receive credit for, 40 quarters of coverage under the Social Security Act;
  3. No longer has lawful permanent resident status and has departed the United States;
  4. Is subject to removal, but applies for and obtains, in removal proceedings, a new grant of adjustment of status, based on a new affidavit of support, if one is required; or
  5. Dies.

NOTE: Divorce does not terminate the obligations under Form I-864.

You cannot remove joint sponsorship from the I-864.  It is a contract between the person signing it and the US government.

K1 seems an odd choice if finances are tight.

 

Do you have savings?

Aha, I see, that is better than a student loan for sure.  However, even if it were a job, I would still play it safe.  100% for sure have someone ready to joint sponsor if needed so you can respond quickly, and honestly, to be safe, and if you can easily get a joint sponsor (like from your parents or another close family member) just do that upfront.  It will be faster and less worries.

I unfortunately blew off all my savings earlier this year.. So i'm slowly rebuilding it back up. 

I haven't looked to much into the marriage visa, but with the marriage visa, an affidavit of support also needs to be provided to? 

 

For me personally, the ultimate goal is for me to bring him to America so that we can start living our lives as a married couple. I even told him that I don't want to continue doing this long distance thing. With this in mind, i also want him to immigrate to America legally as well. So I thought the k1 visa would be our best bet as well as being able to get married.

With a K1 visa, you will start living as a married couple in the US with your spouse financially dependent on you for several months, possibly up to a year or more.  Until your spouse is granted a work permit or green card, they will not be allowed to work.  For your spouse to be able to apply for a green card, you (and possibly your joint sponsor) will need to submit an I-864 affidavit of support form with supporting financial evidence.
