I-864 evidence for AOS interview

Sent in the I-485/ I-864 last December. I'm retired military and don't get a W-2 and didn't have tax transcripts so I sent in the annual 1099-R statements and my  own copies of tax filings. The 1099-Rs show plenty of income. We received no RFE for further documentation. We have our interview in a month and the appointment letter is a form letter so requesting the same as anyone else gets.  So, I 'm assuming they're happy with what I sent. Am I fine with just bringing the same stuff although with one additional 1099-R for last year and maybe this last month's pay statement showing the year's pay so far?

I am new to all of this but for me I would bring what I already submitted when filing to the interview as well as any new income like the last month's pay statement you mentioned.  I printed my paystubs for the last 8 months so far just because I am anxious.   I wish you the best!  :)

We're in a very similar situation. We've been advised to take a copy of everything we filed to the interview with us. + any updated information you have and that includes tax returns (if any) newer 1099 or W-2 if any, etc. 

 

The chances of being asked about income again or another I-864 are not big unless you answer a questions during the interview that indicates that your income has changed. We're filing a new I-864 and taking it was us to the interview just in case we're asked for it. It doesn't always come up, but it might.. and the last thing you want is to potentially get an RFE for it after the interview since this would delay things.

Thanks. That's kind of what I really wanted to ask was "Having an interview date and no RFE, can I be reasonably sure my I-864 is at least pretty good?" Hahahaha

You're very welcome! :)  We had some change in income and our interview is in almost a week now so we've been asking around to see if we'll need to take an updated form I-864 or not. a few attorneys said that since the original I-864 was approved and we didn't get any RFEs regarding it, that most likely everything we'll be fine and that it won't even come up in the interview. However, there's a chance it might come up and if the income has changed (like in our case) we have to take a completed I-864 with us just in case. 

 

I know I just repeated the same thing again but I just wanted to further clarify! We'll let you know how our interview goes and good luck!

Thank you so much! 

I have seen people on a different forum get RFE for incomplete I-864 or for a joint-sponsor if their I-864 income is insufficient. I've also seen posts from people getting denied because their income on form I-864 was insufficient shortly after filing. (some people counted their main vehicle as an asset for example when you can only count a second vehicle as an asset) 

 

So I believe (in my opinion and according to what I have seen) that not receiving a REF for the I-864 and getting an interview notice means that everything is good so far. Also according to some official USCIS and DOS pages it says that a new I-864 is required if evidence arises that the original sponsor is not making enough money at the time of taking a decision on the case. 

 

So if you got an interview notice that means most likely everything is good until this point; in the interview if the matter of finances comes up or the officer is suspecting that the sponsor might not qualify (evidence arises, the sponsor lost their job, or is now disabled, etc) Then they can and probably will ask for an updated form I-864 or possibly a joint-sponsor. 

According to what I have read and seen though it's unlikely for this to come up during the interview, but it might and it's always better to be overprepared than to have to deal with an RFE later.

It's a reasonable assumption to make, yes. My husband got a significant raise after we filed AOS and before we had the interview, and we brought proof of his updated income, but the officer didn't ask for it, and had no income-related questions for us. Approved at the end of the interview.

Hello again! 

Just to follow up with you we had our interview today and the matter of the I-864 or any evidence regarding it never came up! we provided the officer with our tax returns however just to show her that we file jointly and she seemed to look at our total income but that was about it! We got approved on the spot today!

Hey! Did they ever ask you about it? We have an updated -i864 (wrote wrong income )but am worried to even bring it up to cause complication

Unlike the other posters in this thread who were interviewed by a USCIS officer for adjustment of status, it seems you will be interviewed by a DOS consul officer for a visa.  Different immigration processes, different policies.
