Needing 4 proofs of identity, rejected our marriage license

My husband and I went to the WA DMV Wednesday to get him a WA state Identification card so we can open a joint checking account together.  Our attorney recommended having a joint checking together as proof of a real marriage, etc.   The WA state ID will also be good evidence for USCIS because we will have matching identifications showing we live at the same address.  We left the WA DMV very disappointed and stressed because they rejected our certified copy of our marriage license as a proof of identity because it did not have his signature on it.  It has our fancy printed names, ages at the time of marriage and the officiants signature.   After calling the courthouse that issued our marriage license, I have sent off a request to Nashville, TN vital records requesting a copy of marriage application that shows where we both signed to get married.   I really hope they mail back something useful that has my husband's date of birth, name and signature on it and not just another certified copy of our marriage license.  I have recently learned via posts here that the Tennessee marriage license and marriage certificate are one in the same so USCIS should be happy with our certified copy of our marriage license but now need to make WA state DMV happy.  I personally think needing 4 proofs is a lot especially since we are just wanting a regular state ID, nothing special.   We have a certified copy of his birth certificate and his current active British passport.   I also submitted a copy of his i-94 even though it was expired.  I also showed them an electric bill with his name on it, they didn't care for that.   Yesterday we got my husband a WA state fishing license hoping that may work as proof of identity.  It shows his name, DOB, address, and his signature.   I made another appointment with the DMV for 2 weeks from now hoping to receive from TN vital records where he signed his name via our marriage application and hoping they accept the fishing license as proof.   We have emailed the schools he went to in London asking for transcripts/records that show his name/DOB etc but they have yet to respond/acknowledge our request.   ~Anxiously crosses fingers~

My bank, Wells Fargo is requiring my spouse to have a WA state ID as proof of residency.  They will not accept the electric bill that shows his name on it either.  In order for my husband to get a WA state ID, the WA DMV wants 4 proofs of identification which we do not have at this time.   It is a vicious circle and a very frustrating situation to say the least.    I have found another bank that said they will let us open an account with a W8 and his National insurance number.  We have an appointment this Tuesday and hope we actually get to open a checking account together but we still want the WA state ID because that is another proof to USCIS that we are in a real marriage because it will show our address to be the same.  I can't add my spouse to the lease here because he doesn't have a SSN so the matching ID's would be very helpful.

4 proofs of identity? That's ridiculous. Thinking a bit outside the box here... could you draft a POA ( which is also a pretty good evidence of your happy marriage ) and get that notarized? Would they accept that as proof of identity if somebody else notarized your husband's signature on the POA and declared he is who he is... I don't know, just thinking 😂

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

We signed the marriage application.  Our marriage license doesn't show our signatures.   The WA state DMV wants to see my husband's signature as proof of identity.

This is what they said they want: 

Documents that establish your name and date of birth

  • Adoption papers
  • Birth certificate, U.S., or foreign*) — Certified
  • Birth registration card, your card must include your name, date of birth, place of birth, file date, and issue date — Certified
  • Concealed weapons permit issued by a Washington county — Valid
  • Consular Report of Birth Abroad
  • Foreign Driver License or ID card, valid or expired not more than 6 years
  • Foreign Passport, expired not more than 6 years
  • NEXUS, SENTRI, or FAST border crossing card — Valid
  • U.S. Merchant Mariner's card, valid or expired not more than 6 years
  • U.S. Military DD Form 214
  • U.S. passport, expired more than 1 year (an emergency passport isn't acceptable)
  • U.S. passport card, expired more than 1 year
  • U.S. state or territory issued Driver License, ID Card, or photo Instruction Permit, expired more than 6 years
  • Veteran Administration Identification, with date of birth
  • Ward of the Court decree/Order of Dependency

Documents that show name and date of birth or signature or photo

  • Clearance letter or driving record from another state's DMV, issued in the last 30 days
  • Divorce decree, certified by the issuing government authority
  • Government employee ID card (state of federal), with signature and photo
  • Marriage license/certificate, certified by the issuing government authority
  • Medicare card (not a DSHS medical card)
  • Police employee ID card issued by Washington city or county
  • Professional license (nurse, physician, engineer, etc.)
  • School record from Mexico with seal and picture of individual at age of issue
  • School transcript or record, or Forms I-20 or DS-2019 for foreign exchange students
  • School yearbook or copy certified by the school with recognizable photo
  • Selective Service card
  • Social Security card
  • Transportation Worker Identification Credential (TWIC)
  • Veteran Administration Identification, with photo

And we do not have 4 at this time.

The problem is her husband is an overstay for a number of years and doesn’t have the documentation that would serve as WA’s one stand-alone proof, or even two List A documents. So it they are forced to finding four things from List B. At this moment in time, with no immigration status from USCIS, I’m surprised that Washington state ID or driving license is even remotely possible. No SSN, no visa, I-94 is expired, no EAD or greencard, has never had a driver license in US or UK….

 

@Shadaryia If your goal is to get a joint checking account, then talk to your bank about filling out the W8-BEN which is for foreign nationals. Or go to another bank and do W8-BEN. Without a SSN, that’s the accepted path to a US account.  Then you have a joint bank account to use as evidence when you do the concurrent I-130/I-485 filing.

My spouse has never had a driver license anywhere unfortunately.  All he has is his birth certificate and UK passport.  :(

@Shadaryia If your goal is to get a joint checking account, then talk to your bank about filling out the W8-BEN which is for foreign nationals. Or go to another bank and do W8-BEN. Without a SSN, that’s the accepted path to a US account.  Then you have a joint bank account to use as evidence when you do the concurrent I-130/I-485 filing. 
 

I am very happy to say that we did find a bank that will do the w8 to open a joint checking account for us.  We have an appointment this Tuesday.   We were just still hoping to get the WA ID because it would show us having matching IDs with the same address.  I can't add my spouse to the lease here because he doesn't have a SSN  :(

I think sharing your money in a joint bank account is bigger evidence than showing same address at this point. I applaud your efforts to get everything in order and go for the greencard. Other things will begin to fall in place so you will have more by the interview. Getting an EAD will open the door for SSN, which will open the doors for joint taxes, lease, state ID, ETC.
