Is it possible for a person to get away with lying on part 5. Where they ask if you've ever filed a petition for anyone else? Is there a way they will check?

They absolutely will check as your name, DOB, and SSN are tied to all your paperwork at USCIS.

Found love, thought I wanted this path, two years later realized my partner was not worth all the stress 😁

If I answer yes I have filed for someone in the past and our marriage failed will they hold that against me?

Your bigger concern, if you previous spouse is still in the US,  but is not a US citizen,  you are still responsible for them when it comes to the NVC and i864.

HIGHLY not advisable.  It's not worth the risk. Just be honest and upfront about any previous petitions you may have filed before.

Unfortunately, marriages fail all the time.  Every case is individual, so whether they would hold a previous petition that ended up in a failed marriage against you would depend on the specific details of the case.  However, many people file second petitions and are successful, as others have said, lying on a USCIS/DoS form would be much more serious.

Good Luck!

I think that only applies to fiance visas. I don't know where he is. He probably is back home in his country.

That’s not correct. Anyone you petition for whether as a fiancé or spouse etc. Lying is a bad idea for several reasons including the fact that it leads to bans when discovered, the probability of discovery is very high, plus it’s against our terms of service here.

Just be honest that you previously filed for someone, you’re not the first nor will you be the last.

Just another random guy from the internet with an opinion, although usually backed by data!
