Work Visa for a Dental Hygienist

Hi everyone,

First post, and I'll try and make this as concise as possible.

 

  • Indian citizen but permanent resident of (and living in) Canada. Applied for Canadian citizenship but will take a couple of years due to a huge backlog.
  • Registered Dental Hygienist (RDH) in Canada. Also passed US board exams, but not state specific ones.
  • Have a 4 years Bachelors degree from India.
  • Petitioned by US citizen sibling in 2014 (F4 visa; expected wait time is years and years).
  • Sibling owns a dental practice in the US (New Jersey).
  • RDH is not on the list of professions eligible for TN visas.

 

Can the sibling apply for an H1B visa for an RDH, to work in their office? And/or is any other visa category suggested?

 

The company has other partners whose names could be used for filing an application. I'm unsure whether every persons name needs to be mentioned. At the same time, I don't want to risk committing any fraud.

 

Would it be a conflict of interest or misrepresentation etc. to apply for such a visa considering an F4 petition has been filed?

 

If any clarification is needed feel free to ask. Hopeful for responses. Thank you!

Does the sibling understand how the H1B labor certificate, etc works?  Very unlikely he/she could not find someone locally to fill that job.   Dental hygienists are not like Registered Nurses in terms of professional shortages and demand in the US.

 

And yes, it does look shady because of the other petition.

Pretty sure you do not need a degree to be a Dental Hygienist.

Don’t try to hide the fact that there is a family member sponsoring, that would be fraud. There is no such thing as an easy work visa. They all in some way require advertising for US persons first, labor certification etc. The burden of proof is (for obvious reasons) greater when a family member is sponsor.  

 

If H1B is not going to work, I can’t see that any will tbh.  The job zone classification on onet states it is vocational training/associates degree level, and there are not really visas for that kind of level. https://www.onetonline.org/link/summary/29-1292.00?redir=29-2021.00
