applying for I-485,i-131 and I-765 separately.

Hi all

 

I am in the states starting the AOS process. From what I have seen other people post online is that often they are getting their green card before EAD and AP are sent out. My local office case processing times are around 2-3 YEARS for the I-485. I was thinking then of sending the I-131 and I-765 separately and paying the extra few hundred in the hope that these come through quickly. The AP is the most important one to me at the moment as there are a lot of weddings back home that I am expected to attend next year. Are these two forms always done through the national benefits centre or one of the field offices? The case processing for AP appears much faster.

 

Also it is highly likely that we will move to my partners home state within the next 18 months halfway across the country. Will it be easy to change address and get the I-485 interview done in the new state?

Yes address changes are done online and your case will be transferred to your new Local Field Office (not state).

Your timeline will then follow that of your new LFO.

Sometimes, the green card comes first......but it isn't because they were sent together with the I-765 and I-131.  If you send them separately, include a copy of your I-485 receipt notice.  It serves two purposes. It shows the basis for work authorization and advance parole.......and it eliminates the associated fees.

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

You "can't".

You have no valid reason to unless you file I485.

Neither will be accepted for processing.

Technically, a K-1 entrant can apply for work authorization upon entry into the US......however, the authorization would expire in 90 days...thus, it is fruitless since approval takes longer than 90 days.

That's not how it works. As a K1 (before filing for AOS), you're only entitled to an EAD, that is not free and will expire when the I-94 expires. No AP.

Timeline

Even if it were permissible to file before I-485, you do know that the timeline are the same. It does not mean that if you just send one form, USCIS will process it faster. That 1 form still enters the same queue and will be processed when it's time comes.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

So is there a chance I would not get either AP or EAD through before my green card even if it take 3 years? Are all these forms processed at the national benefits centre?
